  • Is there anyone out there who has details with Buchananclark + Wells complaint policy?
    Im out to get them for a change!!!

    I would suggest writing a letter (sent recorded delivery) requesting a copy of their official complaints procedure.

    I think there is legislation stating they must comply within a certain time, but not certain. It may just be more guidelines that are ignored. That's the only thing i can think of though.

    Ooh, almost forgot. If a Utility company makes an error in billing you, they can only go back 1 year to reclaim funds. If you move address and didn't give them a note of the meter reading, then they can chase you, but not if the error is on their end.

    If you think they've breached the csa code of prctice in any way, please alert them to that fact send a complaint form to the csa.

    it really is one step at a time with this disgraceful debt collection agency. You have not stated the full circumstances of the debt, where and when this debt came about with British Gas. Did you actually owe British Gas the money? I don't mean to be rude, but if you contact British Gas directly, asking where this debt is from. Send a copy of the letter to Buchananclark + Wells with a covering letter to say that you are in dispute with the debt, giving them clear time deadlines for responding in writing (10-14 days is the norm) and also state in the letter that you should not be contacted by phone and ALL communications from them must be in writing. That way if you need to build up a portfolio of evidence to take to court, then you have covered this line. If they call you after the 10-14 day period then they are in breach of the harrassment laws, and I would get a tape recorder and state to the caller that you are about to record what they say. This way you can use the tape and let a 3rd party listen to it.

    Don't let these b**tards get to you. They really are pure scum, but if you deal with British Gas, and leave out the parasite, you will not go too far wrong
  • Thanks for your comments. This was a British Gas Debt of which kept harressing me for payment when they had instructions from me after completing a third party waiver that my solicitors were working on my behalf. I was married for 15yrs when my ex husband was caught playin away - which ended up with me and my 3 kids homeless. I had creditors coming out the woodwork for his debts as he went bankrupt - thats why the solcitors are dealing with my crap so to speak. Its come so far that they are !!!!ed and are talking about gettin them for haressment as they arnt writing to them where they sould be. Maybe even complaining to the Credit services association of which is sappose to hold clout as they are sppose to be members of after all they have complaints procedures too?
    Im to much a easy target! now i scan my calls (gone ex directory) and only reply to messages. Letters i forward to my solicitors. Being on Income support sucks, being a carer of my kids and there problems is the only think that keeps me going - if they havnt got me who have they got?
    I just gets me so mad that BCW thinks that they can get away with all this intimidation..
    WHat would you recomend? any help much appreciated.:confused:

    oh hun what a horrible time for you, this scummy company make me so angry x i dont really have any advice for you other than to keep smilling this scum will get what is coming to them,

    There are some letters that you can access through links on the forum here, sorry but I am not allowed to post links on this forum, so have a look through the Buchananclark + Wells threads. Have a look at the letter that I put on my thread as well, as it may help you to compile a letter. Make a point of noting that they must not call you as you are in dispute with the debt.

    I am sorry to hear of your circumstances, but you have your children and I'm sure that they can give you all the love you need to get through this.

    just read one of your posts again:-

    My wife has been told that British Gas will no longer deal with Buchananclark + Wells (BCW) for debt recovery of cash owed to British Gas. The letter dated 22nd Sept is bang in the middle of when British Gas called my wife to tell her that their dealings with BCW have ceased, so BCW may still be writing out to the last of their British Gas debts. I would write to British Gas complaints department, outlining the problems you have had with BCW and detail when they have called and send copies of any letters sent to you from BCW. If your solicitor is able to write the letter, then all the better, but I would direct you efforts to British Gas and sent a strongly worded letter to BCW as I mentioned in my last post.

    BCW spent a bit of time pursuing me (or rather MrsLA) for a debt for British Gas.

    Eventually I had to prove, in detail, to British Gas that they in fact owed me money.

    BCW can only act on the, evidently, occassionally flawed info they get from BG.

    Without wanting to sound like an apologist for DCAs I'm sure that a lot of people they deal with are trying their best to avoid a legitimate debt and when you've heard the same excuses or been given the run around 20 times that day a degree of cynicism must creep in.

    Noe of that excuses unlawful methods of course.
