Ebay buyer wants to return but item exactly as described!

    Flutter, in regards to defamation:

    Firstly, taking someone to court for defamation is extremely expensive. I can't see the buyer doing that, somehow.

    Secondly, you can back up what you've said in the feedback in that you have proof (emails).

    So, stop worrying. The guy is a muppet. He doesn't have a legal leg to stand on. You haven't defamed him, as what you've said is true. He tried to blackmail you. Your case will be made even stronger when paypal finds in your favour.

    maybe this person seeks out people with 100% feedback, and has his own little scam....?

    he requests a refund, but never actually returns the item.... then he blackmails you with removing his negative?

    i would just tell him to take you to court if he wants to.
  • £10 for removing negs, report him to Ebay. forward the email to them.... Soo will know where. Thats DEFINATELY against Ebay rules!!!

    hi, poor you flutterby butterfly. I doubt that guy has any case against you. what does he hope to gain by taking you to court?
    besides he did try to blackmail you. that email should be proof enough. I think he is just trying to frighten you into giving him more money to keep quiet. I think you should stay strong and don't bow to the pressure. he has probably done it to other people. maybe you should try contacting people who have sold to him before via his previous feedbacks, see if he has done this before.
    it may be best for you to tell your husband and get his advice 'cos it may save you the unnecessary worry.
    or you could send this nasty guy an email saying that your husband is a very good lawyer and you would be happy to see him in court! tell him you have the email about the blackmail and the judge would definitely be interested in it. if he blackmailed you then i don't see why one can't put that in the negative feedback. isn't that what negative feedback is for?
    don't worry too much, i am sure ebay will find in your favor.

    I must admit, I agree with hjb - prior to the pathetic threats and attempted blackmail i would have suggested accepting a return, as i generally work on the principle that the customer is right even when they're completely, madly, barkingly, staggeringly wrong..however, now that he's trying to give it large then i would say "bring it on if you think you're hard enough". From what you've posted he hasn't got a leg to stand on, and i very much doubt that legal aid would take on some sad case like this....so it would cost him far more than the item every did in legal fees...if you are desperately worried then get abit of legal advice (most solicitors will give you an initial 30 minutes for nothing - or they do where i live, or use the CAB or local Law Centre)...but in all honesty i think he's just full of the brown stuff....as no doubt the paypal dispute process will reveal.
    Please don't worry...and especially don't worry about a bit of negative feedback - i honestly think most buyers read the negative and the response, and aren't going to not buy on account of one negative, especially if the response to it is reasonable...

    hello

    first of all print out all your emails from this chimp so you have hard copies (also in case something happens to your pc!)

    now then, you have his email address and his home address, log onto some "male adult" websites and put in the email box his address saying 'yes i would like to receive 1000's of pics of naked men in my inbox' or whatever you think would annoy him the most, if he is arrogant he obviously loves himself, also sign up his home address to loads of junk mail and other crap that comes in the post.

    it might not get your negative turned around but it will make you fell good!!

    You could actually come out of this a winner. If he's returned the item BEFORE PayPal have told him too and therefore hasn't sent it either recorded or special delivery then he can't prove that you have received it and therefore PayPal will award in your favour.

    It's quite possible that, for example, you might be out when the postie brings it back and perhaps another member of the family might accept it and then forget to mention it to you until after the PayPal case has closed....if you get my drift. Hopefully your item will arrive intact and as new, then you'll have it and the money ;)

    Agree with all the above posts. You are the one in the right not him. Don't let him bully you.

    I wouldnt hold my breath though with regards forwarding abusive emails to ebay. I have been receiving abusive messages from my ex on ebay and they havn't done anything about any of them.

    The irony of all this is that my husband is a lawyer and really should be giving me advice on this but I daren't even tell him about it because he's told me not to use ebay anymore after we had some cases of fraud commited against us. The draw of ebay is too great for me though!!!
