Made redundant & no holiday pay?

My daughter was made redundant at the end of July after working for a retail company for 5 years( 3 years P/T 2 years F/T). She received her redundancy pay, but no holiday pay.When she queried this with her manager, she was told that because she had been off sick for a total of 9 days this year, that she hadn`t accrued any.

Could I ask whether this sounds right? Thanks for reading this and any advise would be much appreciated.

    Did she take the sick days as holiday or did she self cert herself as sick?

    If she took the days as sick days then she will still be owed holiday pay and should contact her employers Hr dept.

    Assuming she followed the company process for sickness absence reporting etc then this is not correct. Sick pay should not be classed as holiday leave unless the company has sucessfully disputed her sickness absence previously.

    In addition, companies certainly cannot decide to alter absence status on a whim so far after the event! In terms of a redundancy termination, the individual must either be given the opportunity to take holiday (and informed that they need to take this prior to leaving) or this should be paid out by the company.

    Your daughter needs to query this as (from what you have posted) the company is in the wrong here.

    Given they have the holiday wrong

    did she get 5 years service redundancy and 5 weeks notice.

    Actual redundacy will depend on age.
