HELP - Ebay seller refusing to sell me item I won

Hi,
I won an item (pick up only) at a bargain price and the seller took ages to respond to my e-mail asking when I could collect. I thought they were p***ed off they didn't make as much as they prob thought they would (but that was their fault cos they started it at 99p and it had no reserve and finished at a stupid time). Anyway I then got an e-mail saying they wanted my permision to cancel the transaction (the seller gave no reason) but in the comments they told ebay the item had gotten badly damaged and was now unsellable. They would have to throw the damaged part of the item away. They then e-mailed us the same thing.
I e-mailed back saying could they please send me photos of the item now and we could decide if the transaction should be cancelled. Of course he can not cos it isn't damaged so they have replied saying they have given the undamamged part to a friend and they threw away the damaged part?! (the items comes in two peices)
What do I do???
This is all obvious lies!!!
Is the only thing we can do is give very negative feedback or can we do anything else??? It is obvious he will either relist this with ebay or sell it through local paper now or something - if they haven't already!
Please help!! I don't know how people do this, it is so morally wrong, I couldn't have done this to someone! :mad:

  • Don't agree to the cancel transaction- he'll get his fees back if you do agree... and report him to ebay other than that there isn't much you can do.

    A broken item is a valid reason to cancel a sale in Ebay's eyes, the seller may not be lying and even if he/she is, I doubt you or Ebay could prove the seller is lying (unless the exact same item suddenly gets relisted), so I would guess that kicking up a fuss about it won't get you anything except some hassle.

    just refuse to cancel and neg them to warn others that if an item sells for les than they want it ends up broken and unselable !

    Exactly the same thing happened to me recently. Seller said the dress had been advertised in error, and she couldn't now sell as it was her daughters. She had not put a reserve on it and it was incorrectly spelled. It was a complete lie as she had had 10 days to realise it was onsale, and let the auction run to the end. Ebay did nothing, and she asked for me to cancel neg feedback.

    What can be done if it does?
  • He should have kept an eye on his auction listing and pulled it before closing time. If it finished at 3am, then that's his fault. He must let you have it.

    You cant force him unless you go around with gun (which i am not condoning) . All that can be done is Neg him and move on. If you sell as well from that account put him on the blocked bidders list
  • thanks for all your posts. We e-mailed him giving him 48 hours to basically come clean or prove the item was damaged or else we would report him to ebay and give neg feedback (he has 100% at the mo for the last 12 months) although I looked back and a similar thing appears to have happened in 2007 :rolleyes: He has replied saying sorry we are dissapointed blah blah blah and to report him and give neg feedback - so we will. I am so angry. I am watching to see if he re-lists it but I am guessing he will sell it in local paper of something. But what can ebay do if he or a friend relists it?? He could just say it is a different one??

    There is nothing you can do.
    Leave negative feedback (although threatening him with it wasn't a great idea, check threads for Feedback Extortion) and move on.
    Watch to see if he relists it, but if he does all you can do is buy it again, and would you really want to deal with someone who is most probably rather underhand?
