Argos - refund or replacement?

Right bought a exercise bike from Argos today and after putting it all together I noticed that it doesn't sit right - like a table with a wobble caused by a dodgy leg.
As I built it in my garage I thought it might be the floor but I've since taken the bike into my kitchen where I know the floor is level and its still the same. So now I have to take it all apart again and re box it.
Anyone with Argos experience know if I can get a refund or will I have to accept a replacement? TBH the built quality doesn't seem very good so I'd rather take a refund and buy another model but I don't think I can legally demand a refund if they want to offer a replacement...

According to the Argos Returns Policy:
"Most things we sell are covered by our 30-day money-back guarantee, so just return them to us unused, in their original undamaged packaging, in a saleable condition, with your receipt and we’ll give you a refund."
If the packaging is undamaged you may be able to obtain a refund under that guarantee, which would save you a lot of hassle. I've returned things to Argos before with no problem.
If the packaging is damaged, you still may be able to get a refund if you return it as faulty but the road may be rockier. I haven't tried that, so won't comment. Good luck.0 -
Its used though as in the box has been opened and all the components put together. I do have all the bits of packaging but it is not re-saleable due to the fact that it is faulty.0

Why not take it back and say you want to return it. When they ask you why, explain what happened and let them decide if that means it's faulty. Whichever they decide, they owe you a refund or replacement, and probably you can get them to agree to a refund.
Once I took something back (not to Argos) with the packaging undamaged but I couldn't repack it the way it was packed when I bought it. The customer service assistant claimed that meant it was not in a saleable condition. But when I asked him to refer it to his manager, she gave him a withering look and took it back and gave me a refund.0 -

This statement is totally irrelevant. The item is FAULTY. The 30 day MBG doesn't come into it.
Take it back for a full refund. It doesn't matter if the packaging is damaged.0 -
Colliefrog is spot on. You can reject the goods as not being fit for purpose and get your money back. That is your statutory right under the SOGA...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

lets us know how you get on, they will prob try and pan you off with a credit note. they will say they can repair or replace it first(lol send it for repair, that'll never happen). when you say you dont want another they will offer credit note. stick to your guns though.Thanks all. Will take it apart and return it tomorrow and request a refund.
ive had to return 2 buggies to them and 2 credit notes issued. didnt mind as i needed other things but have 3rd time decided to buy elsewhere.

Update:
Well I took it all apart, boxed it back up and returned to Argos expecting difficulties after reading others experiences.
Turned out to be really smooth. Walked up to the counter, said it was faulty and asked for a refund - which was given no questions asked

was about to post when last one popped up! if its faulty argos usually very good. especialy if you return quickly - and not months later!0
