Halifax! No record of loan!

I sent off the letter etc and got a letter back saying to ring them (halifax). Spoke to nice lady who says they have no record of my loan. I don't have the paperwork as was settled in 2005. The loan is on my credit report and also have bank statements with the payments coming out. Anyone help as to my next step???

Hi there, have you asked if they could try to supply the agreement to you, this is what would show the loan and if ppi was taken etc with your account number details.
You normally enclose a £1 postal order or cheque payment and they should supply by 12 days, if they are unable to supply it they should return your payment with an explanation in writing.
Remember to write the account number which is shown next to the repayments on your statements.
May I ask what letter you sent to them, was this for paperwork or a reclaim letter?

Have you moved address or changed your name at all? Try giving them all your past addresses and names.
They can't send you the loan agreement without the loan number and if they can't find the loan, then they can't find the loan number.
Halifax loans normally start with a "7/" or "84" if you have any paperwork with a number like this on then that could help too.0 -
I think the only way to retreive the credit agreement for definate is by way of a SAR. If you are actually requesting it and using the CCA 1974 as your weapon in which "they have to supply within 12 days" then you request for it also has to comply with it too in what that law states in the CCA.
. If you use section 77/78 to request it (which is whereby they have to produce it in 12 days which is what Di mentioned above) and they do not send it then you can take them to court and they have to produce it BUT ONLY if the account is not settled.
I am only giving this advice as you may waste 12 days and also what can you do if they do not supply it... "nothing" as they did not have to send it anyway....
You can however request a SAR from them which is all the information that they hold on you (usually only going back 6 years but some have had stuff from going back further) but it does take 40 days for them to supply it and costs £10. (template letter here)

However on saying that, some companies would rather supply the agreement to you (even though they do not have to within 12 days) than actually produce a SAR as sometimes there is within the SAR a solid reason as to misselling and they get caught out.
The choice is yours but if you request it and they do not send it within the 12 days there really is nothing you can do to follow this up as you were not entitled to it anyway. You are entitled to a SAR though.
