Visa Chargeback as a supplier?

Inspired by the question of the week, and the fact that we have just had money once again took from our paypal account under a "bank reversal" I was wondering what right of appeal the supplier has in chargeback situations?

I know it is possible to fight it through paypal if you have a proof of posting if what they are claiming is non-reciept, however as they have left positive feedback (on ebay) for us I suspect that in fact they are just scumbags wanting to get away with our goods.

They probably got the idea from here (I have seen more and more tendancy towards illegal and immoral behavoir on these forums recently) so I was wondering if this site could for once see the other side and help a small business to fight against unfair chargebacks.

    How do you prove it?

    I think you could take them to court but the cost and hassle is probably what stops most people doing it.

    Things you would need to prove:-

    Did they receive item? Obviously quite easy if item is found in their possesion, but I imagine if the heat was on they would soon dispose of it.

    Probably easier to prove a pattern (ie they have done it before) but would ebay help without outside (legal) pressure?
  • If you don't have proof of postage then I would say that you have nothing to go back to them with, even with proof of pogstage - Paypal will normally find with the buyer (the terms and rules are heavily weighted in the buyer's favour and most contact with Paypal is met with an automated response which has nothing to do with the dispute).

    For us, this meant that we now sending EVERYTHING recorded delivery.It's shame that we have to do it, but I agree with you - this kind of scam is definitely on the increase.
  • Twice my bank has agreed to implement a chargeback for me due to non-receipt. Once was over a PayPal credit card transaction. I first had to send the bank evidence to show that I had tried to resolve it with the supplier (for instance, by writing or emailing them to ask "where is the whatsit I ordered?"). If some banks are doing chargebacks without requiring any evidence, it's a problem with those banks, not with the chargeback facility.

    Speaking personally, if it wasn't for the chargeback facility, I would be wary of trading with any online merchants other than big names, and absolutely definitely would never trade through Paypal. I think there's advantages for small merchants because of that. If you judge that you're losing more from chargeback than you're gaining from increased business, you could always refuse card payment.

    I agree with you by the way that some threads in these forums can be quite unpleasant. Amazing what some people will complain about. On the other hand, in many threads people with real problems seem to be getting genuinely helpful advice, so it's not all negative.
