Road Markings - Speed cameras

Do the road markings after the speed cameras have to be clearly marked as double/single yellow lines and parking bays for fines to stand?

Only asking, out of curiosity honestly, as there are a few in our area which are decidedly ropey and very hard to see.

Not sure whether you're on about speeding fines or parking fines here.

Yellow lines and parking bays have nothing to do with speed cameras; the hash lines on the road after Gatso cameras are there to provide a secondary check of the radar speed, based on the two photos. The lines are either 2 metres or 5 feet apart dependent on the area, and the distance travelled between the two flashes 0.5 seconds apart, must be within 10% of the radar recorded speed.

If the lines were too faded to perform this secondary check, this might be argued as a defence, but it would depend on whether the Magistrates had been given chocolate hobnobs with their morning tea break.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Thanks for the reply bargepole, it was to do only with speeding cameras as I know that road markings on parking bays can be used in defence if not clearly marked and wondered if the same applied to speed cameras.

Should I ever get caught on one and find myself infront of magistrates the first question will be

"have you had chocolate hobnobs with your tea this morning sir" :rotfl:

The road markings have for speed cameras have to be evenly spaced and precisely located. There is some guidance on the distance of markings but I can't remember where. They might be with the rest of the road markings in Traffic Road Signs General Directions (TRSGD) which is the official document issued by the Minstry of Transport for regualating road markings and signs. It contains all the spacings and widths.

There have been some cases overturned as the speeds based on the secondary evidence was demonstrated to be at significant odds to the primary.

Mind you don't get hit by a "speeding car"..........:D

Not that I'm suggesting criminal behavior but a can of petrol and a match on the yellow box might be more effective.........;)

The TSRGD 2002 doesn't include speed camera markings as they're not for use by the public. The cameras are usually accurate anyway, so the markings are neither here nor there unless, as you say, there has been a major malfunction and the lines used as secondary evidence. Remember also that if you are speeding the two photos will show the car positions significantly far apart and other landmarks (including other road markings) in the picture can be used in evidence. Calibration markings merely make the police's job easier.

There are dozens of threads on pepipoo, including some high-profile cases, where the cameras are most certainly NOT accurate.

The ACPO code of practice stipulates that a secondary check MUST be carried out, and must corroborate the primary (radar) reading within 10%. The markings, whilst not part of the TSRGD 2002, must be sufficiently clear to enable the check to be made.

It is my experience that the mandatory secondary checks are more observed in the breach than the observance.
Bargepole's comment about the biscuits is truer than many realise.
