We've only heard a fraction of the story. They must have gone 50/50 for a reason, so you should ask for details of their reasoning.
How did the photos prove beyond all doubt you were stationary? Your insurance company is meant to act in their own financial interests. Insist that they go to court to defend their liability in the interest of saving their costs.
If you haven't already done so, writing is far more effective than phoning and talking to some 17 year old call centre muppet.0 -
Halifax don't insure the other party by any chance do they? If so, it would be in their interest to go 50/50, then they can keep half of both drivers' excesses and bump up your premiums to boot.0

You would have thought so wouldn't you? But my own experience tells me that its often cheaper for them to settle 50/50 for lower cost claims than it is to fight them. They must have gone 50/50 for a reason, so you should ask for details of their reasoning
We had what I call a non-accident last year - on a country lane we were stationary but car coming the other way misjudged the road/his speed, put two wheels on the verge, lost control and ended up in some trees: no injuries but his car was a write off. Even though there had been no contact between the cars we stayed to find out he was ok and exchange details (just in case). Other driver tried to blame it all on us (said he had to swerve to avoid us) and involved the insurance companies who then decided to settle 50/50 as there were no independent witnesses. I was absolutely furious but there was nothing I could do to make them change their minds :mad:0 -

I had a taxi reverse into me at a junction once, it does happen!0 -
Thanks for all your replies, the accident was on the 11th July and have now instructed independent solicitors to deal with halifax/e-sure, the reasoning behind them settling or trying to settle is no witnesses!
The other party reversed out of a car park space while i was stationary and kept coming even though i blasted the horn and hit the front of my car on the offside, it would be impossible to get the damage there if i was moving!
Got photo's from the scene also, please dont get insured by e-sure pick the easiest route and dont care about their client!
Sent my renewal with no no claims, now £1600 from £600 the previous year!0
