Car insurers will not help with claim

hi can anyone give me some advice please , last Friday someone crashed into the back of me while i was waiting at a aroundabout.

My car was quite damaged but it is an old reliable peugeot while his a 2008 merc was fine ,we exchanged details and i thouhgt it would be a straight forward claim as i was stationary and hit was from behind.

I contacted my Insurer on the same day , and they said they were 95% sure it would go in my favour , i contacted my insurers again yesterday for an update and was told that the other partys insurer had not been in contact .

Bur this morning i received an emaik from my insurer stating

" As you have Third Party, Fire and Theft cover on your policy we
are unable to deal with the repairs to your vehicle or chase another insurance
company for an admission of liability.

However, we can provide you with the details of the other insurer so that you can discuss liability or repairs to your vehicle with them directly. "

Is this normal practice as i have never been in a crash before, i cannot afford a solicitor so i am left with a damaged car and whiplash.

Any help or advice will be much appreciated

    Yes, its normal practice, i think you will either have to deal with their insurance company yourself or do you have legal cover for your house insurance. They should be able to help or go to one of those no claim, no blame solicitors.

  • I'm in the same situation but my insurer put me intouch with a firm that would handle the claim for me.
    They put me in touch with a local solicitor who's dealing with it (and I dont pay).
    Id call your insurer and ask if there is someone that they deal with that would handle it for you. Failing that, the firm that first contacted me was Silverbeck Rhino.

    Just to add, the other insurer also contacted me and offered to deal with it all for me if no-one else was.

    The legal cover on a Home Insurance policy will specifically exclude dealing with motor claims.

    You can either contact the other Insurers yourself and ask them to arrange repairs and / or a courtesy car or you can contact an accident management company who will probably take it on if they feel you have a good case especially if there is an injury involved
  • hi thanks the quick replies , would it better to speak to a solicitor before phoning the other parties insurers . I have thought about the no win no pay option but i have heard that they just refer you to a solicitor and if you win take half of the money.

  • When I was in an non fault incident I used help hire. Here is some blurb from the website:

    'Helphire is the UK's market leader in the provision of non-fault motor accident management and legal services solutions, including vehicle replacement and repair management, full claims handling assistance, uninsured loss recovery, personal injury management, intervention services, as well as a host of bespoke services.'

    I don't have any experience of any others, but they were fine. They gave me a nice courtesy car - equivalent size/spec of my car and they liased with the other party. I paid a tenner at the start - I can't remember if it was refunded or not. This sounds silly, but I am trying to remember why I didn't use my insurers (I was fully comp) - I think it was because I did not want a piece of s**t coutesy car lol

    If you want your car repaired its a really bad idea to go to companies like helphire. It will bump the cost of the claim up and the other insurer will want to write your car off simply to stop the helphire bill. You'll then be left with no transport. Try asking if the other insurers will lend you a courtesy car first.

    Be very wary of Accident Management companies and accepting a vehicle on credit hire which is how they will make their money (unless you have an injury in which case they get two bites of the same cherry).

    Speak to the third party insurers first, ask them if they are prepared to accept liability and mention that you are considering employing someone like Helphire, Albany Assistance or Accident Exchange. You should find they move heaven and earth to avoid the exhorbitant costs of these companies.
