Holiday Accrual during Notice Period?

Hi,
I know this is not a redundancy question but thought it more appropriate to ask it here.

I am currently working my notice period and my employer has asked me to take my outstanding holiday during this period, which I am happy to do.

What I want to know is do I accrue holiday during my notice period, or did I stop accruing it the day I handed in my notice?

Many thanks in advance..
Ian

You accrue holiday up to your termination date.

However if you work until say the 29th of your final month some employers may not allow you to claim that months holiday as your service within it is incomplete. Depends on the company policy and/or the flexibility of HR (and if I'm being honest, to some degree whether you have been a pain in the ar*e to HR!)

  • So as my end date is 25th Sep 2009, and I gave my notice on the 28th August 2009, I should accrue holiday for those four weeks?

Is there anywhere I can read the legislation that explicitly states this? I've been searching for several hours and can't find anything that states it.

I ask because i think my HR manager has calculated my remaining holiday wrong and my holiday entitlement wrong.

    Thanks..

when does your holiday year from from /to? It is easier to start from the beginning and look forward to your end date

If it is Jan 1 you should have 8 months accrual + up to another months allocation depending on policy/if they are feeling nice. Obviously you then need to deduct holidays previously taken

To work out the monthly accrual simply divide your annual allowance by 12.

  • Pete111 was right. It will depend on your company policy. If the policy states holiday does not accrue if you terminate within the month - ie prior to the end of the month and this would apply to you - then it will not accrue. The only time where this would not likely apply is where you are being paid the statutory minimum holiday entitlement.
