Help! MBNA CC Payment Protection Query

I have a question regarding the point raised below -does anyone have an idea whether I can go ahead with a PPI claim against MBNA based on the information listed below? I opened the account with MBNA on 17th April 2001.
MBNA sent me a photocopy of the tear off sheet (signature form) only. It says across the top 'Credit Agreement Regulated By The Consumer Credit Act 1974, and it is signed and dated by me with my signature. For the first time ever since opening the account I have noticed the PPI box ticked 'YES'!!
I know for a fact I would never of ticked this box because I always refused to be roped in and never sign myself up for additional costs. I've never even knew IF I have been paying PPI because theres nothing in my statements ever to show for this. Where do I look? Do I also have grounds to claim for this?
Thanks

Hi there
I would definately give it a go.
With your reasons you have they have 8 weeks to respond in full.
Keep at them until they resolve or until they issue you with the final decision, which should include if eligible the details of the financial ombudsman service (FOS) you should be able to take your complaint to these if your not happy with the outcome.
Here below is the link to Martin's useful guidelines of reclaiming, with a checklist of mis selling reasons and template letters, you can use the templates if you want to or as a guide, do not worry about writing in the amounts at this time though, post by recorded delivery as your proof of posting, good luck.;)

Hi
Thanks for your reply. I feel a bit stumped. I've had a look through the link you sent me with the checklist of mis-selling reasons but I cannot find any information on the reasons I am stating/want to claim.
Those being - the box is 'ticked' by someone (not me) on the credit agreement and looking at my statements I don't see a 'separate' line for any PPI payments going out? Unless they include this figure in the 'interest' that they charge me each month?? I'm confused now what to write exactly when using that template letter.0 -

Hi there
If you don't see the reasons of yours in the checklist, you do have already have your own here, they are examples of mis selling etc....
If you did not sign for the PPI, then the chances are that this was manually done by them.....crafty this of them.
If you have an agreement this should show if PPI were taken and the amount of the loan, where they did probably add the ppi in with the loan repayments.
So your argument here would be that you did not believe you signed for the PPI basically.
I take if this is what you mean here? The one and only "Dizzy Di"0 -
Hello Di,
Thanks for your reply. It is not a loan, it is a credit card (MNBA Platinum).
I remember clearly, that it was one of those many mailshots from all of these companies they bombard your letterbox with. It was a good offer at the time with a low APR, so I filled in the application form, signed and dated it and applied. I certainly did not check the 'box' of any payment protection as I'm well aware of these additional costs involved. Thats why I was alarmed when I recieved a copy of the initial agreement - all they sent me was a copy of the tear off sheet at the bottom of the form.
**Actually due my own stupidity, I sent the bank charges initial template asking for a breakdown of my charges/direct debits etc and a cheque for £10 (I'm in the process of trying to claim off 4 different credit card charges and 1 bank account charges (I wanted to just at least get my bank account charges stuff up to date and on file pending outcome of the court case) so I sent the credit card company the wrong letter and in return they sent me a copy of my agreement as stated above. !! And thats how I found out.
Yes - in a nutshell, what I mean is that I did not sign up for any PPI/PPA. Thanks.0 -

In regards of the charges, have you also tried posting on the reclaim charges thread as well, Natweststaffmember has good knowledge in this field and can give the best advice there is, so if you have not done so yet, then give it a go, well worth it, here:
