Virgin CC (MBNA) Claim sucess but not enough?

Hi everyone,

We have a vigin credit card (mbna) with PPI. I put in a letter stating i was misssold etc. I could not work out how much I have paid PPI because they wanted to charge for copies of statements that I was not prepared to pay for.

I have had a letter back today saying as a gesture of goodwill they have credited my £138. This does not seem enough to me but I am unsure of the correct ammount.

Should I send them another letter back asking for more but I dont want to loose out on the £138 they have gave me?

Can anyone draft a quick wording for me?

    Hi there

    You could try by writing to them to request they post you a "full detailed written breakdown of how this was calculated" this should show how this was worked out and where the PPI comes into it. This is completely free, ask them to send them by 5-7 days, and post by recorded delivery, you should be entitled to see these calculations.

    If you find there is more, and they do not agree by paying this out, you can always take your complaint to the Financial ombudsman service (FOS), but ask them to consider it first, fingers crossed.

    Unfortunately for statements there is a charge for them, where most have to request for these with payment, however a SAR (subject access request) if you request for this they should supply all the information they hold on you for £10 postal order or cheque payment, but this may take up to 40 days before they can send them, hopefully though it would be sooner that that.

    Are MBNA known for making low offers? The way I see it now they have admitted they are wrong

    Not a problem, good luck.

    I think the main of them try it on with low goodwill offers myself, but keep on at them anyway, until your happy.;)

  • When replying should I state the the ammount sent is not enought and that we Accept it without predujice as an interim payment?

    If I can't get an exact figure can I put in the letter we would accept £x aslong as the figure is reasonable.

    I am frightend that they may withdraw all offers or do you think now they have offered a goodwill payment they are admitting they were wrong?

  • I have just received a full payback of all premiums on my MBNA.

    I think the key recommendation for anyone contacting their bank for refunds is to make sure you have the upper hand by knowing your rights, having all facts, including that obtained via a SAR, and really hammer these facts into them. Once they know you have them over a barrell, they cave.

This depends on how you feel about it, you could if your not too certain on it just ask them as stated above to send you the full detailed breakdown, this way you will know, in case its a big difference, and of course you always have the FOS to ask to investigate if your not happy.     They do normally let you know if they are upholding in your favour, if this was the case then you should receive all you have paid in PPI and interest etc, yet with an offer it may be a lot of difference.
    They should not discriminate you from offers, if this was the case then they are not treating you fairly.;)

    A goodwill payment is just that "goodwill" and admitting nothing. ALthough you and I know they would not offer anything if they were not in the wrong a lot of people accept these and they can be quite a bit lower than if you went to the FOS. I would now write back and state that original complaint still stands and that if they cannot refund all the PPI and 8% statutory interest on top (as you were deprived of the money.......that is providing you have no arrears??) then you will take this further with the FOS. They may then write back and let you take this to FOS but "sometimes" as soon as FOS requests the file they come up with the full redress. It is entirely up to you here of course and its only my opinion. As regards them taking away their "Offer" etc, they would not be treating you fairly if they did this and this could be thought of as retaliating.

  • well I have just dug out all the statements I could find. By the look of it the £139 they have refunded me is the correct amount for the premium I have paid over the last 3 years.
    They have not gave me the interest back and the stat 8%.

    I done some quick calculations and I estimate the interest to be about £15 in total. I am not going to bother chasing for that, by the time I send recorded letter at £3.5 etc....

    I have looked online and the money has been taken from the balance already!!
