Questions about paying off Debitas

I have some questions I want to ask about paying off Debitas who have to be the most ruthless bunch of money-grabbing Bastitches ever!

1) If I make a offer of payment monthly, am I within my rights to say that this offer is on the condition that they don't ask for any documentation such as breakdown of monthly expenses, bank statements, etc? [I'm currently unemployed and claiming JSA with most of my money going on bills and other expenses]
2) Am I within my rights to ask them to stop harassing me if I keep to my payments monthly even though I've tried to sort things out within them and their staff are rude. [I've tried to block their numbers but Skytalk say they can't block 0845 numbers]
3) If I do make a full and final offer, am I within my rights to ask that I will only do this on a payment plan?
4) How have other people dealt with these guys?

    Regarding no.2, there's a template on here somewhere where you can tell them they aren't allowed to talk to you on the phone anymore and can only communicate by writing.
  • I've sent a letter concerning their constant harassment towards me by recorded letter and now they've passed on my account to another credit agency called "Credit Solutions".

    I'm going to call Capital One, Debitas and Credit Solutions to get this sorted out once and for all...

    On another note, am I still within my rights to refuse to send the organisation concerned a breakdown of my expenses as well as a copy of my bank statements...

    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
    I now require all further correspondence from your company to be made in writing only.
    I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    Personally I wouldn't call them. They will lie, fob you off and bully you over the phone. I would only deal with them in writing. Do you know what this debt relates to? Do you agree that you owe them the money?

    You don't have to provide your bank statements to anyone (unless its a judge in court). You don't have to send them an income & expenditure account although it is standard practice for them to ask and most people do provide one.

  • Thanks for the advice that has been offered since I did a update on my current situation.

    Basically, it was due to a situation where I tried to pay off my credit card but unfortunately a combination of various factors prevented me from doing so in full even though I tried to get them to accept a payment plan but they kept fobbing me off, and now I've found that I owe more in bloody charges than the actual debt itself!:mad:

    I agree that I owe over £314 including charges and the debt itself and I'm willing to pay 25% of the debt off over a period of 3 months but I need further advice on how I should word the letter that I'll be sending Credit Solutions including my refusal to send them documentation as they seem hellbent on harassing me until I pay in full even when trying to explain to these people again and again that I can't pay in full as I'm currently unemployed and that I have other bills and debts that have higher priority than this one.

    On another note, the only reason why I got my account passed on to Credit Solutions seems to be because I stood up to Debitas and told them by letter sent last week by recorded delivery that I would look at taking legal action if they kept on harassing me by phone [I sent them a copy of the letter that 'gettingbetter' posted in this thread] and that I would correspond with them by letter.

    It's bad enough that I have Epilepsy and that a lot of the time it's triggered by stress but I'm worried that if they keep harassing me by letter, I'm going to end up with a fatal seizure at the end of the day...

    You're under no LEGAL obligation to provide and I&E to them, if they insist on one, ask them to confirm which part of legislation they're referring to that states you must provide and I&E.

    If you're receiving constant harassment calls, it may well be worth considering changing your telephone number even if you have to pay a fee, that way, they'll have no option but to contact you in writing.

    You need to bear in mind, they're is nothing they can do apart from commence legal action, all the threats and intimidation will only add to your condition, if and when they do decide to take legal action, that's the time to change gear, until then, remain in control and try not to allow these muppets to dictate your life.

    If it gets to that stage, I may consider changing my number and only giving it out to trusted people as well as going ex-directory afterwards...

    I definitely won't send them any documentation like a I&E one or a bank statement...
