Tribunal says CSA must pay £31K back to NRP but…

..does the PWC have to pay back the CSA? old CSA laws

    CSA made a wrong decision when calculating maintenance, they said I am not allowed to travel to work and pay rent and the law said I can and the tribunal has backdated the correction to 1999 resulting in a refund plus interest. Employer and landlord both gave statements to the tribunal. Ive had no contact with PWC for 18 months, that her choice. I dont think PWC gave CSA false info.

    Does PWC have to repay the CSA when it was the CSA that got it wrong?

    edit yes she got the money from CSA, who else would it go???:rolleyes:

    If the PWC was on benefits then most of it would go to the Secretary of State and PWC would have got to keep £10 a week of it (now £20 allowed)

    Does anyone have a sensible answer to the question. Does the CSA make a not-at-fault PWC pay back maintenance overpayments when the CSA is found to got it wrong at a tribunal?

    From the way your post reads it sounds like it was the CSA's fault, so the PWC gets to keep it all unless it was owed to the SoS.

    Good for the PWC, I say, if she got the money. It makes a change;)

    Congratulations on receiving your money back and with the interest it's even better.
  • Thanks you so much Maya, My concern wasnt for PWC but for my children and didnt want the CSA to put them under hardship, I am thinking of using some of the money to apply for a contact order or similar.

    My refund cheque hasnt arrived yet, no idea how long it takes. Lots of technical gobbledegook talk between judge and the man from 'the agency'

    CSA error means PWC should not be asked to repay any overpayment.

    They will have to do a full breakdown of your accounts to check for any other errors before they refund, so possibly 6 - 8 weeks before your hear from them. No harm calling them in the meantime to check it's in the pipeline though.
  • The children are under 18. I think the threshold is 19 if in education. I might be wrong.

    Im in no hurry for my cheque from the DWP to land on my doormat. It all accrues 8% interest to date payment is made by the DWP when it is known.

    Not sure why I need court forms, the CSA stuff was way over my head.

    Im wondering why LizzyS posts have mysteriously dissapeared :rolleyes:

    Hopefully they do.
    The make the NRP pay up arrears when it is the CSAs fault.

    The worm is turning for these unfortunate people hopefully and the playing field is levelling out.
