Damp Proofing

Two years ago my wife and I bought the house we are now living in and as part of the purchase agreement the seller agreed to install injection damp proofing. The house seller handed us a 20 year guarantee, so we thought we were covered. Now, however there is a discolouration creeping up the hall wall and is making its way up the stairs. Looking at the guarantee I find that we should have informed the company of change of ownership within 90 days as its the customer who is guaranteed not the work, however it was never pointed out to us and with everything else we had to do at that time I never got round to reading the small print. I have emailed the damp proofing company but haven't received a reply from them. Any idea what my legal rights are with this?

As it was done as a condition of the sale, maybe you should speak to a solicitor, but I wouldn't hold my breath - it's not uncommon for such an agreement to be voided after a sale or transfer of ownership.

Should your original solicitor have advised you of this? ie to change ownership?
