How long do Lambeth Council have to respond to initial correspondence against fine?

Apologies if this has already been covered somewhere else on the forum.

I received a parking ticket from Lambeth on 12th May 09. I sent off my appeal by recorded delivery on 19th May 09.

I'm yet to hear anything from the council. On their site they say 'we anticipate responding to initial correspondence within 3 months.'

Does anybody know if there is a date beyond which I win this case by default?

Cheers

I can't answer your question exactly, but I hope you kept a copy of your appeal and the proof of delivery. There have been stories on this forum of people appealing to the council, hearing nothing, then having bailiffs turn up months later claiming they ignored numerous demands and correspondence and demanding hundreds of pounds in accumulated fees.
  • Yeah I've got both stored.

And in my fantasy alternate reality I get to fine the council an amount for being so slack in sorting this out, and it doubles every additional two weeks they leave it....

They are not required to respond to such an 'informal' appeal --- although they MUST consider it (yeah daft I know).

If they intend to progress with the enforcement process they have six months in which to serve a Notice to Owner. (beginning PCN service date generally).

-- and as I keep telling people --- DON'T use recorded.

I guess if you track check that on RM site you will find it was NOT 'recorded' - i.e. you pay for a service that you then don't get.

just use 'proof of posting' --- free. For more important stuff pay for SD.
