Maternity leave - Not returning to work

As everyone said, yes you accrue holiday while you are on Maternity pay, so will be entited to it regardless of if you choose to go back afterwards.
You have to give the same amount of notice as you would if you were at work normally (check your contract!), but if you have missed it, could always take the remaining few weeks as holiday?Isabella Molly born 14th January 2009

Thanks for all your replies...It looks as if she might get paid for her 25 days accrued interest which is a bonus as we were not expecting that....She has to give 8 weeks notice, so needs to get the letter to her work by the end of the week....I'll ask her to ask the question whether she will get paid in her letter...

If you have enough leave, you could always say you are coming back and immediately taking all your leave then resigning. It would get round the problem of needing to come back to work to get your leave.
Logically, I would have thought the leave accrued would be reduced according to your leaving date. So if your leave year ended at the end of April and the last date you could return from maternity leave was end Sept, you would only have under half your leave entitlement. (as you would only be employed for half the leave year).
But I would have thought you could say you were technically returning end Sept, then taking leave owed to you and then resigning towards end Oct, having taken all leave owed. Of course you will have to tie in notice dates on returning or not (2 weeks) and notice on leaving (8 weeks) so maybe do it all in one letter.
When I worked in civil service (decades ago) you had to return for one month in order to keep all mat pay that was greater than SMP. People used to save up leave to take in this one month that they were returning for, just to keep the extra mat pay.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Has she checked to make sure there are no specific conditions on her company maternity pay, as in the NHS trust i work for, as someone has previously mentioned, you have to return to work for 3 months at the end of maternity leave, or you have to pay back all the maternity pay received from the company :eek:0 -
She has not got her contract to hand, but her company did ot give any above the standard maternity pay so I guess that she prob will not have to pay any back?
She is going to send an email to her HR manager to clarify her rights regarding the accrued leave and see if she needs to give 8 weeks notice prior to her scheduled return or 8 weeks prior to her return inclusive of her accrued 25 days leave...
She is a member of a union so will check witht hem (if they say she is not entitled to it....
