can we reclaim

Hi i'm new to this site and have just seen an advertisement for this site.

to cut a long story short, my brother put in a claim to reclaim bank charges before it was put on hold (whilst the case was going through court)
my brother died in january this year and me and my dad are executors of his will and assets.
as he put in the initial claim before he died could we still claim what he had worked so hard for (and been so ripped off for).
its not the money it was the thing that so iritated him most in life because the banks were !!!!!! with him for 11 years of his working life (i know you can only reclaim 6 years)

    You can go back to July 2001 under the FSA waiver on Bank Charges.

    My condolences to you and your father on your loss. I am sure that it has been a difficult year. As executors for the estate I would write to the bank requesting statements back to 2001 and restate that you will be reclaiming the charges back from the bank as executors for the estate. They do not have to deal with the bank charges complaint until the conclusion of the OFT test case since financial hardship would not apply, I'm afraid but remember to claim all that is owed to his estate.
    I hope that helps but give a shout if you need more advice though.

  • thankyou it is not about the financial hardship its about reclaiming for him because i know he was so peev'ed off with the banks when he was alive, i'll keep you updated
