New car finance and cancellation Help

Sorry I have just realised the heading looks like it is a brand new car. But the car I was purchasing is the garages demo car so not brand new.

Last week I paid a deposit on a Fiat 500c. I asked for advice from the board and have now spoke to the garage about cancelling the purchase and recieveing a refund for my deposit.

I made this desicion based on the praticallity of the car as it only has two seats and isn't really suitable for my job. I also explained to the garage that I was on the understanding with the garage that these cars are very rare and at the moment there is a big waiting list for the 500c. Today I have found an identical match for the car at £1000 less.

I have propsed to the garage that I would like a refund of the deposit I paid of £1300 minus 15% to cover the garages inconvience. The garage have asked me to put this is in a written form. Is this normal and reasonable.

    I would say it is reasonable for them to keep it all, so it is IMO definitely reasonable for them to ask you to put it in writing
  • It will probably say in the terms and conditions of your order for that the garage reserves the right to retain or persue you for an amount equal to the costs incurred.

    If you have ordered a saleable spec then what you have proposed might well be reasonable.

    If you have awful taste and have ordered a horrible colour combination speced like a Christmas tree then expect them to keep the whole lot.

    For future reference when your are leaving a deposit on car this means you are buying it having considered things like practicallity price etc etc. You are wasting peoples time and money faffing about like this.

    Good luck getting you deposit back, unfortunately there are no hard and fast rules, its really up to the garage to decide reasonably what costs they have incurred.
  • I do know that I have faffed the garage around. I dont know if it makes a difference or not. But the car isn't brand new it is the garages demo car so was viewed on the forecourt.

    Yes it vastly shortens the list of possible cost's they could come up with. Get a letter sent pronto and you should get what you've asked for.

    Do I just put I want my deposit back minus 15% as a good will gesture or shall I give reasons.
  • Its up to you but if any of the reasons are things you could have feasibly known/worked out before hand i'd leave them out.

    An apologetic tone would be best to open - it is after all a situation of your own making, there is plenty of time for stern letters if they are un-reasonable.
  • The garage have offered me 50% of my deposit back which equated to £650. I know I have ballsed up but do I have to accept this.

  • You don't have to accept anything it just depends whether that bit of extra money is worth your time and effort getting it. To some people it is, to others they would sooner right it off as bad luck and move on with their life.

    I'd ring up and speak to the Dealer Principle or at the very least Sales Manager and say you think £195 is more than sufficient to cover their costs/inconvenience. If they say its not ask them to itemise any costs incurred.
    It is then up to you to decide whether the list and associated cost they come up with is reasonable or not.

    Do you like any other Fiat cars that may suit your needs better? Maybe the Punto or Brava? They would probably let you transfer your deposit.
