Hello
thanks for this- very useful information! It is much appreciated.
This problem relates to a bank account- but I don't have an account number etc because I don't have any statements etc.
Would I just send part A in a letter to HSBC?
thanks0 -
does the threat letter letter u have recvd not show any account numbers? your recent letter shud throw at least that up but if it doesnt, have u any other way of getting them, old statements somewhere, try the bank themselves even? dont worry about it being a bank account, they will simply write back saying they dont hold, or need to hold, an agreement due to the exemptions of running account credit blah blah blah.
the main things u are looking for are charges and when and how this debt was sold, along with the correct default/termination procedures i think. the charges will be on the statements, the sale and def/term procedures should be detailed on their comp records, along with what they sent and when.0 -
Hi
the letters they have sent have a reference letter (i.e their ref number) no details of my HSBC account. As you mentioned, I have sent the prove it letter asking for all the details, but I suspect they won't do anything with that.
If I send the data subject access request with a postal order to HSBC will they respond? Or does it need to go to fredericksons do you think?
thanks0 -
HSBC or Arrow, the original creditor or the now owner, not the monkeys in between, this is a direct data request not a request for info outside of that organisation. try n find out urself via HSBC but if they cant even provide an account to which this debt refers, they are in going to struggle.0
-
HSBC are the original creditor- no idea who Arrow is- it just says it on the letter from FI.
Is the aim of the SAR to find out when the account was passed on to the DCA?
And is it really so that if it ever went to court, to show I have acted methodically and properly?
sorry for so many questions0 -
dont worry abt the questions, im not making it clear enuff.
SAR is to get the info u need to tell them to b***er off. i think that will be charges over and above the value of the claim if im honest. the other point is their rightful ownership and the production of the documentation to prove such. there are other things but these are the most prominent in my thinking.
sorry i thought it was Arrow that now owned it?0 -
Hello
On the letter from FI, it says 'Our Client: Arrow Global ltd.
who they are I do not know- I have never had any dealings with them
0 -
yes they have bought the debt from HSBC by the looks of it. they should have told u via a Notice of Assignment that they now do so and tell u what it is in relation to. if they have not acted correctly, they will find it very very diff to enforce this.0
-
Hi
well I sent the 'prove it' letter off asking for details- I doubt that I will get any proof of statements etc. If they do not reply to that letter, should I do the SAR thing, or shall I just wait and see what happens?0
