    I have not had any correspondence from HSBC for years and years. They never informed me it was going to a DCA. Also, the letter I got asking for the £258 this week was the first I had heard in years. It is so long since I had any dealings with HSBC that I don't even have a trace of the account.
    The DCA letter says they are acting for Arrow global. The actual account in question was opened in 1996. I couldn't tell you when HSBC passed it over.
    Should I write asking for the proof of the debt with statements etc. Are the obliged to show me them or not?

    yes i think u should and indeed they are if u ask correctly, but a simple letter first, asking for an outline and proof of the debt, account numbers, dates, any charges on the account, full statements, etc within 7 days should suffice for now.

    rite looks like arrow have purchased the debt. in doing so they must have abided by strict guidelines but dont worry abt that for now.
    have u changed address in that time at all?
    im a little confused as to whom and when u started paying the £100/mth.

    I paid some monies each month or every 2 months or so for a while years ago because I knew I had an overdraft with HSBC and wanted to clear it. I had the account details in my payees of my main bank account, so I would pay the odd ammount every now and then, but I was never getting anything from HSBC (or anyone else) acknlwledging the payments. That's why I went into HSBC in 2005 to find out what was going on and they told me the account had been shifted to DCA because it was inactive. He also said that because I had paid some monies, that's probably why I hadn't heard from the DCA. They didn't tell me what the remainder on the overdraft was.
    I haven't changed address and have only now, years later, got any correspondence from them.

    ok well i think the above stands. send them a recd del letter, unsigned asking for ALL the info on this account. ask them to provide this within 7 days such that u can assess your situation with regard to this debt, as at the present time, you are unaware that you ever had an account with arrow glbl and you have had no correspondence with them in the past. if u dont get a reply, send a SAR (ask if u need a template) to the regstd address of the bank and possibly one to arrow to see if they have the required documentation. might cost u £20 unfortunately. see how u get on with that first effort tho.

    lol, its a tad heavy handed but i like it. is that the royal 'we' ?
    try and put in there along with the evidence that you require including but not limited to, original creditor details, account numbers, statements to prove the amounts claimed, details of their ownership of the debt, along with anything else they have to prove you are the debtor in question and copies of any correspondence they have previously sent to you etc, etc. and give them 7 days in which to comply...in writing

    The cheeky gits have sent me another letter saying
    THIS DEBT MUST BE PAID IN FULL TO THESE OFFICES WITHIN THE NEXT 7 DAYS OF WE WILL TAKE IMMEDIATE ACTION
    and they have mysteriously added to my bill including interest court fees (£15) and solicitor costs (£50)
    AND THEY HAVE JUST PHONED ME - I hung up. What a bunch of saddos on a Saturday morning- clearly they can't get girlfriends!
    I will await their response from my letter but if they phone me I will do the harrassment route on them

    ignore the letter, notice how empty the threat is: "we will take immediate action" , then adding solicitor fees to make it look like court action, frightening enough for some tho.
    any calls, u simply say that u will only communicate in writing from now on and please put a note on ur files to that effect.
    get a SAR ready (do u need a template?) to go soon as the 7 days are up. may seem like a waste of a week but might save u the tenner!
    there are other methods of gaining disclosure at your disposal but this is, in my opinion, is the way to treat it for now. if it ever gets to court you can show a clear and concise methodology of endeavouring to gain the facts of the case.
