Hi,
I need some advice please ladies and gents,
Earlier this year I claimed FH as my partner and I had mort arrears due to an injury at work (which he didn't get paid for, but thats another thread!)
I was partly successful with the Alliance and Leicester as they paid half of the charges back and his bank- halifax- are still stalling. Anyway, on the 7th of Sept a DD of £22.00 was taken which was out of the agreed terms with company and now I have incurred charges again. I invoked the DD indemnity to reclaim the amount which has been returned but now I am left with a £25.00 charge and an over OD limit charge of £5.00/day for £3.11 of which only 11p was the original OD over limit. It took the A&L three days to DDI the money back and now they won't consider giving me the charges back as they have GOG my account once this year and I am to be charged the best part of £50 for the privilege
sooooo.... My question is:
If u have claimed charges back under the FH system and you get more charges can these be claimed back or should they be applied in the first place?

If you incurred charges then the DD Guarantee Scheme is usekess since it doesn't cover charges)but now I am left with a £25.00 charge and an over OD limit charge of £5.00/day for £3.11 of which only 11p was the original OD over limit. You can reclaim charges from any company but I would be surprised you would get it back under financial hardship unless you have priority debt arrears and that this specific charge has contributed to the arrears but it might in the future. I would still reclaim but I doubt you'll get FH on that basis specifically.0 -
i have claimed under the hardship rules from alliance and leicester but have been told they are only allowed to pay back 6 months of charges which is just 3% of the total amount claimed and they initally refused to acknowledge recipt of 2 letters 1 sent recorded delivery untill FOS sent a letter0

Most banks look at priority debt arrears so it would make sense since mortgage repossession would be from 6 months arrears. Interesting to know since it makes sense in a waytaylorandy3 wrote: »i have claimed under the hardship rules from alliance and leicester but have been told they are only allowed to pay back 6 months of charges which is just 3% of the total amount claimed and they initally refused to acknowledge recipt of 2 letters 1 sent recorded delivery untill FOS sent a letter0
