removing private clamps yourself...

I live on a 'private' estate in south london........what the clampers try to get away with is just modern day highway robbery............so.......I offer a free service to my neighbours to remove them.....as far as I'm aware....as long as I dont damage the clamp (criminal damage ?) or keep it from them (theft)....I'm perfectly entitled to do so....and have done on numerous ocassions.....they even watched while i did so recently!.....An hour with the car, a few sockets and a jack......

However.....one person I released came out next day to find two tyres slashed, another had a phone call to say if they didn't pay, they'd tow the car from the driveway! Isn't that sort of conspiracy to steal or something??.....the owner caved into the thuggery......I was gutted....

we're dealing with crooks......I treat them accordingly but people crumble under pressure

also....the signs often say......'by parking here, you are entering a contract...'......however...this is only pressumed, assume or implied consent....so....put a nice big notice in your winscreen stating....'I expressly and categorically DO NOT consent to entering a contract with you over parking here'.........sure, they'll still clamp you.....but photograph THAT for the court guys !!

    I must say, it is very kind of you to offer such a service. And I wholeheartedly agree that private clampers are amongst the many scum of the earth.

    Can you really see them trying to go to court for a £5 padlock~??
  • what if you did destroy the clamp, if there were no witnesses what could they do? surely you could say you came back to your car and knew nothing of it? they may have photos, but they would have no proof you actually took the clamp off, it could be some anti clamper hero who goes round taking them off.

    Removal of the clamp without damage is perfectly legal. Please not that this refers to Private Company clamps, do not attempt this for DVLA clamps or those attached by bailiffs acting on a proper court warrant.

    The tyre slashing would seem to be a clear, and criminal, attempt by the clampers to dissuade this legal practice, I would suggest that video surveillance is a good idea.
    A neighbour watch scheme which enable a dozen or more people to attend the scene very quickly may pursuade the tyre slashers that their actions are foolhardy. If that approach was used then great care should be taken that there is no hint of violence or threats from the neighbours to the clampers and it should be videod from multiple vatange points.
    Of course if the tyre slashers are exteremely criminal they could then escalate in their reprisals so there are risks. However, bullies need to be bearded or they will just continue.

    A plan formed by the residents in the area needs to be made, the ethios nneds to be preventative noy confrontational. And it needs to be executed correctly. Perhaps involve the local Crime Prevention Officer from the police. The oath taken by the police entails upholding the Queen's peace.
