fpn issued but it was not this car

A friend of my son has a fpn for an offence in Hull and he lives in Hertfordshire, never been to Hull. He wrote and explained this but they say the penalty must stand and he has to complete Part B which may mean going to court. Anyone have any advice.

    Sorry the crystal ball is on the blink again. What sort of offence? Who is the FPN from, council, police or what? What evidence do they claim to have?

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Could well be faked plates.
    Similar thing happened to FIL. He was able to show that the car using the plates was the wrong make, and somewhat more importantly that he was driving the real one in Spain at the time.

    OK, Police issued parking tickets will go to Magistrates' Court if not paid. Make sure he keeps a copy of letters sent, and try and get some proof the car was in Herts, not Humberside, at the time of the alleged offence. Enter a plea of Not Guilty.

    If the CPS are stupid enough to continue with a prosecution, he must go to Hull and defend it, using his evidence to get the case dismissed. Then claim costs from central funds for travelling to Hull (return mileage @ 45p per mile) plus all postage, stationery, phone calls etc.

    If Humberside police want to waste public funds, make the b***ers pay through the nose.

    I thought someone made it clear you need to give proper detail.

    Too vague. What 'offence'.

    Important cos the Police are not responsible for enforement in Hull!

    It could only possibly be 'obstruction' I think.
