Bank Charges Query

Hi Everyone!! :beer:
I have just read an article on another Consumer Forum that stated that I needed to change my initial Bank Charges Reclaim from a "penalty" to a case of unfairness as it is likely to be thrown out by the Bank??!!
If your claim is merely based on penalties then your bank will have a basis upon which to ask the court to strike the claim out. You should take steps to amend your claim immediately.
What are your thoughts on this?
Also, while I have my moaning head on (LOL), I haven't received any correspondance from my bank HSBC for well over a year and a half!!
Any advice or words of reassurance would be great.

Thats correct but to be honest I would leave the case as it is currently on hold/stayed until the outcome of the test case and the courts have been instructed on whats to happen. unless you want to tie up a bit more money in the claim as the n244 application to amend the claim bears a cost, and I believe that would be held in the stay anyway.
Most early particulars of claim templates included both penalties and utccr so should be okay, but if in any doubt post up the poc you used.LegalBeagles0 -

I agree with you totally. It find it is so frustrating, and arrogant of the Banks to think that they can add more and more debt onto people who are struggling, yet harp on about how important it is to manage your finances and be a responsible borrower. What about the responsibility of the lenders/Banks?
