DLA Claim

Hi there, I'm currently claiming incapacity benefit (Income support based) and in the process of selling my flat. I intend to move in with my girl friend who earns around £26,000 a year. I will certainly lose my right to claim IB but I am told that I may be eligible for DLA. Is this true and if so what do I do?

    If you have care and mobility needs you may be entitled to DLA. You need to contact the DWP for an application form.

    Claiming DLA does not relate to you not qualifying for IB/IS.

    Cheers. I did make a claim for dla on the advice of the lady from CAB who was handling my IB appeal. I was turned down and the reason given was that my IB had been stopped. I've since won my appeal.

    You need to check the paperwork again. I would be very surprised if that was the reason given.

    It was a while back and I've forgotten the exact wording but the comment certainly referred to my appeal situation. By the way, I'm almost sixty. Does my age make any difference?

    What will happen if I am not being paid anything? What do I do?

    Your age should not make a difference.

    The IB medical reports may have been used as part of the DLA process, but it should not have been based purely on the fact that your IB was stopped.

    I'm not sure what you mean about not being paid anything?

    I've been told I'll lose all claim to benefits as my partner earns too much.

    You will lose your claim for IS. When you move you will need to advise the DWP of your change in circumstances.

    Could I ask why you are not entitled to IB - were you previously self employed? Had you been entitled to IB, you would have still received it.

    You can still claim DLA, this is not means tested.

    I don't know DMG. I'm guessing that it's because I had been out of work for two years prior to claiming IB. Not enough stamps? I know that I get income support.

    I'm sorry if things are not clear but I had a stroke recently and I get a bit confused at times.

    Yep, not having paid enough stamp would have meant that you would not qualify for non means tested IB.

    Definitely pursue your claim for DLA. It will provide you with a bit of your own income. If your claim does fail, CAB will be able to help you with appealing.
