Post Divorce Consent Order

I am hoping someone may be able to advise me on whether I need to have a consent order, 5 years after my divorce and 2 months before I remarry?

Am I right that after remarriage to a new partner, there is no need for a Consent Order on either side?

My ex-partner is rather prone to over dramatising situations and since I am trying to afford my wedding at the end of November I could do without yet another draw on my meagre funds. HELP!! :-)

    I'm a little confused about your situation! Why did your solicitor not draw up a consent order up before your divorce was finalised? I have recently gotten divorced and was told to wait until the Consent Order had been agreed before I applied for the Degree Absolut. I'm not really an expert on divorce, but my solicitor was quite adament that we wait until the consent order had been agreed by the judge before the absolute was applied for. It seems like along time to wait after your divorce to sign a consent order!

    Your remarriage doesnt stop him making claims against you but would bring your own financial claims against him to an end. However, after being divorced for over 5 years, a court is highly unlikely to entertain any financial claims. If you try to get him to sign a Consent Order now you may just be opening a can of worms.

    It is correct that your solicitor (if you had one) probably should have arranged for you and your ex to sign a consent order providing for a clean break (ie no further financial claims against each other in future) but there are occasions where its not done e.g where parties instruct their solicitor that they dont want to wait to sign a consent order as they just want their divorce asap.
