Welcome - refund onto balance

New to this site but hope it stops me from bangin my head against the wall!
I asked a solicitor to act on my behalf in claiming back PPI from Welcome. The loan was over 5 years and the PPI was over 3 (??!). After 18mths. Welcome accepted the policy was mis-sold and refunded the premiums - back to the balance of my loan!! They did this without my agreement and are refusing to refund the premiums back to me - the solicitor has tried to contact them but they are ignoring them. I have now asked for help from FOS as the solicitor is getting nowhere fast.

The other thing they did - I was on a payment plan as I really struggled with the payments. Just before last Christmas when they acknowledged the mis-selling, they referred my account to County Court for attachment of earnings - without telling me!!! I only found out when my HR director called me into her office, asking if I had finacial problems!
They are a nightmare - I don't know how they get away with how they conduct their business, they are a bunch of bullies and have breached my confidentiality on so many occasions.
HELP!!

Does anyone think I will get the premiums refunded back? I don't care about the balance of the loan, it's just the money could be used for other important issues in my life at the moment.

    My girlfriend had exactly the same problem with another financial company when she worked. She was having trouble paying them each month and agreed a payment plan which she kept to, then before she knew it (last xmas) her wages was a lot lower than usual - when she got back to work after her holiday and the xmas break her work explained it was a detachment of earnings from them and they would have told her had she been in work. Unfortunately she paid twice that month as her standing order was sent to them too...she ended up leaving that job as after the CSA payments of 28% and this she couldnt afford her train to work anymore!

    im afraid i cant give me help in your case but thought i would let you know that your not alone with companies doing this
  • Surely if you owe money on the loan and they have taken the money off the loan you owe them a lot less, will be paying less in interest therefor making you better off in the long run.

  • Thanks!! I actually when to Court last week and was successful is overturning the attachment of earnings order - the Judge was really understanding and agreed that Welcome had acted incorrectly, considering i had a letter from them agreeing to nomial payments! - it didn't help that Welcome's solicitor didn't turn up for the hearing! I feel a bit better now - just want my premiums back!
  • Broken Hearted - Nope, it doesn't work like that with Welcome. I've just found out that they had also ben adding interest since August 2005, despite their confirmation that this wasn't to happen. that has to be deducted from the loan, but not the PPI premiums - this is money that I have paid for a policy I couldn't claim on.
