Yes clutton I checked the terms and conditions on the tenancy deposit web site and it does mention a third party so I have emailed them @ the address it gave but im waiting for a reply ...
And Jowo it is now a single tenancy in the young mans name ... and the way he got round the letting agent giving me back the bond was by telling them he was repaying me back in installments ... thats why I think they have sent me a letter to sign stating it is ok for them to keep the deposit ... I called them and said I didnt agree to them keeping the deposit and I refused to sign this but they have still refused to release the bond ... thanx0 -

Hi Kaz, I really do feel for you! Personally, I think your son should share some of the responsibility for this. You presumably trusted this friend of his, precisely because he was mates with your son? If my mum had been let down by one of my friends like this, I would give her the money back myself and I would chase the friend for the money back, I think it's a bit rich of your son to have you running round like this?! Sorry, it's probably not a helpful reply!0

I have wrote a letter re action before court ... is this sufficent before I send it does any thing else need to be included ..

On 31/10/08 I paid the sum of £480 as bond money on 178 **** road.
It was agreed that you would pay me half of this money, but this never happened. As my son was living in the property, this wasn't an issue.
As my son ***** no longer lives at the property, and you requested to take over the bond in April with myself and ****** property management I now require the full amount of £480 paid to me within 14 days, failer to pay will result in court action being taken
Please write the cheque out to and send it to <my address> by <i date in 14 days time>.

What i am struggling with is - if you lent the full bond jointly to your son and his mate - why are you wanting to re-claim all of it off his mate ? Your son owes you half - it is up to him to repay you (from whatever funds he has) and then up to him to challenge his mate and the letting agency if they refuse to return his half.0
