Well done Shafted.
Do you need to wait until it closes (June 2010) before it's submitted for a response.
If so can it not be closed earlier?0 -

Did your payment not increase from the November payment?
Have you actually complained yourself? To whom?
1 - Barclays First Plus?
2- Financial Ombudsman?
3 - Office of fair Trading?
Or are you waiting for others?
If you've actually taken the first step here and actually complained to BFP then once you've got the final response you need to complain to the FOS & the OFT as the terms breach the Unfair Terms in Consumer Contract Regulations 1999.
That said, it is going to be a long slog to get these regulators to listen. This is precedent setting as none of the regulators have had to decide on such an issue as far as i can gather.
The FOS say they won't consider the UTCCR
The FSA say it is the responsibility of the OFT
The OFT say they don't deal with individual complaints.
I've recently asked the Parliamentary & Health Service Ombudsman to advise where responsibility lies. It may be that there is a gap here and it turns out that none of the regulators are actually obliged to rule. In that case we would need to take the issue to court ourselves.
This is a major issue, contrary to the thoughts of some on here. Many BFP customers will lose their homes once base rates recover.
Anyone who believes it is acceptable to pass on all base rate increase but treat base rate decreases as a bonus for the banks shareholders clealry should refrain from commenting on a loan forum.0 -
