Advice please - DRO surplus income

Hi,

I start uni next week and will be either applying for a DRO or bankruptcy for £10K of debt. I understand that under a DRO you cannot have more than £50 a month of surplus income. My query thought is that my student loan is paid quarterly into my account so whilst it is to last the quarter, I will for two months have surplus...does this mean I can't get a DRO? I hope this makes sense to you.

Thanks in advance :)

  • Hi Helen,

Have you spoken to a debt adviser CAB/Nat Debtline/CCCS? if so then they can give you a definitive.

I would think that your monthly`income` is the sum received divisable by the period of months it covers. That it is paid in advance is immaterial as it still has to last that long. It is the surplus on the monthly income vs the monthy outgoing that is subject to the £50 excess.

Good luck with the start of Uni next week.

  • I agree with angel, it would simply be adjusted in to a monthly figure.
