Is it worth taking through MCOL?

Dear All,

I wondered if you could give me some advice please. I have been trying to reclaim my catalogue late payment charges since July this year. This is through Littlewoods home shopping group. I am currently on a DMP and the charges amount up to what would pay off one of my accounts (I have 3.... and so much just want to pay them back).

I have now written 3 times, the first asking for the money back, the second time trying to negotiate a little with them, saying I'll only reclaim 12 months worth and if it was acceptable to them to pay off one of my accounts and last time to threaten them with MCOL. They are just not having any of it..... so is it worth me claiming through MCOL? The court costs are £35, which I would be happy to pay out, if I lose, well I lose, but if I win this I will ask for them to pay my court costs. What do you all think, is it worth taking it that far, or should I just forget it??? Has anyone else had any luck with Littlewoods???

Any advice gladly received.

    I think it is worth going to court, i do think court gets a faster response, and yes you can reclaim court costs and add 8% pa interest to the claim. And none of this only claiming 12 months worth either, claim everything. You have threatened them with it so carry it through.

    Post up your particulars of claim when you are done so someone can check it over :)

  • Further to this, Ive just had a response from FOS saying unable to uphold as they wernt a member. So that leaves no alternative other than MCOL. Just scraping the £35 together now.

    Have you completed your MCOL claim yet Plain Stupid ?

    Filing at your local court using form N1 is preferable to MCOL. The two main disadvantages with MCOL are that your Particulars of Claim are limited to just 1080 characters with a maximum of 24 lines and you cannot attach the schedule of charges to your claim.

    Therefore I would strongly advise you to file at your local court. If you use MCOL, it will be transferred to your local court eventually anyway.
  • Ah..... wish I had read your post before I sent the MCOL off. Ah well, never mind I will have to send the list of charges off seperately with the ref number.
