Do not trust mbna!!!!

Hi all.I was recently offered an early settlement figure on two mbna accounts.I was offered a deal to pay a sum in august or if i couldnt manage that i could settle in september at a slightly higher rate(DUE TO PREVIOUS PAYMENTS).I spoke to ccca and they said i needed the settlement to be full and final.I emailed the guy at MBNA with the details of this and requesting the offer in writing.This was in august and they never sent anything in writing.I am now the proud owner of two default notices!!STICHED UP!!I am now at a loss what to do as the reasoning behind these settlements was to avoid my accounts defaulting.According to the original email offer i have untill the 28th september to settle the accounts.Is it really worth believing these ****wits.I rang them yesterday and spoke to a brainwashed **** who said the defaults werent entered in error as i should of payed in august.WHAT!!!I think i cold stich them up in court.Any help and advice please.Cheers DS.

  • Your complaint is, I think, that you were told that the settlement offer was valid until 28th September, but despite this your account has defaulted.

    I would check the wording but I doubt whether the offer meant that you did not have to make the August payments, if you hadn't settled by then.

    If you don't meet your contracted payments on any account then you risk defaulting. Even if you had made the offered settlement, MBNA would probably still view this as delinquency (a delightful industry term) because they were writing off (or selling on) a portion of the balance.

    You can't break a credit agreement and expect it not to impact on your credit score.

    Anyway I don't mean to sound harsh, and I do sympathise, but I don't think you would have any recourse to the courts. If you'll forgive me I think you've been a little naive. And your thread title is right - do not trust banks!!

    No doubt RAS will be along shortly - he knows his stuff and will be able to give you some specific advice.

  • Yes that is my beef MLF.If they wanted a payment in august that would of altered the final settlement figure and there was no mention of this.And as regards being naive i dont think requesting something in writing is naive,but i do appreciate your input.All in all i am a self employed person who is disillusioned with these big bullys who ride rough shod over people like me.I want to fight them!Thanks anyway.
  • I agree with you that they treat customers with contempt, they are inefficient, slow to admit their own mistakes while punishing customers severely for theirs, but I just don't think you have a legal case for having the defaults removed, however unfair it may seem. However I'm prepared to be proved wrong and I wish you luck.

    Being on a DMP with many creditors, I've had many situations like this where I perceive that creditors have acted unfairly. Rather than have my life consumed with fighting battles I have little chance of winning, I have resolved to just keep my head down, pay them off as quickly as I possibly can, get them off my back and learn from my mistakes never to get into any of these vile companies for any money ever again.

  • They might not have made it clear but no way part payment was going to get you out of every black mark they could put your way, your credit file will carry details of this agreement for 6 years
    In London, you're never more than 20 feet away from someone telling you you're never more than 20 feet from a rat .

    If you didn't receive a default notice before they were put on your file, it might be worth contacting nationaldebtline to see what legislation or guidelines have been breached.
