TERMS AND CONDITIONS FOR 96.3 RADIO AIRE'S 'LIVE IN A SHED' COMPETITION
1. INTRODUCTION
1.1 The terms and conditions set out below (the "T&Cs") apply to the 'Live in a Shed' competition which is being run by Radio Aire Limited of 51 Burley Road, Leeds LS3 1LR ("Radio Aire") and https://www.wedotrades.co.uk c/o EBH Web Limited, Princess Exchange, Princess Square, Leeds, LS1 4QY (acting jointly as the "Promoter").
2. REQUIREMENTS FOR ENTRY
2.1 To be eligible to enter the competition, an entrant must:
(a) be resident in Radio Aire's transmission area of West Yorkshire;
(b) be at least 18 years of age;
(c) not be employed by or connected in any way with the Promoter (i.e. employees of the Promoter and their families, agents, or anyone else professionally connected with this competition);
(d) either have a mortgage on or be renting a residential property located in Radio Aire's transmission area of West Yorkshire which they are resident in for a minimum of 50% of their non-working time (and be able to provide evidence of their mortgage/rental payment schedule);
(e) be available (i) from 14 September to 18 September 2009 for interviews with Radio Aire; and (ii) to live in the Shed (defined below) 24 hours a day from 21 September to 2 October 2009.
(f) not have a criminal record (currently or previously) and/or have had criminal convictions made against them;
(g) not have won a competition operated by the Promoter, or been awarded a prize provided by the Promoter, since 15 February 2009;
(h) be of good medical health both physically and psychologically.
2.2 By entering the competition, entrants confirm that they comply with the above eligibility criteria. The Promoter reserves the right to immediately disqualify a Participant (defined below) on discovering that he/she does not meet any of these criteria.
2.3 The Promoter is entitled to request evidentiary information or conduct their own verification in respect of an entrant's compliance with any of the above eligibility criteria prior to selection of Participants (as defined below).
3. PARTICIPATION IN THE COMPETITION
3.1 By entering the competition, entrants agree to be bound by these T&Cs.
3.2 To enter the competition, entrants should complete their personal details on the entry form which can be found at 96.3 Radio Aire's website https://www.radioaire.co.uk (the "Entry Form"). Entrants are also required to explain on the Entry Form why they think they should be chosen to go into the Shed (as defined below) and provide an interesting fact about themselves. Answers to both of these questions should be limited to a maximum of 100 words. All entrants must complete the Entry Form entirely before submitting it, complying with all requests for information. Incomplete Entry Forms will be rejected. An entry must be submitted online by midnight on 11 September 2009 (the "Deadline"). Entry Forms received after the Deadline or submitted by any other means (including by post) will be rejected. One entry per person.
3.3 Proof of submitting the Entry Form is not proof of receipt of an entry. The Promoter is not responsible for any entries that fail to be submitted for any technical reason whatsoever.
3.4 A panel of judges from Radio Aire (the "Panel") will review all valid entries and select 25 entrants to be interviewed (the "Interviews") by the Panel at Radio Aire's premises between 14 September and 18 September 2009 (the "Interviewees").
3.5 All Interviewees may be required to provide upon request by the Promoter full and accurate details of their health including any existing medical conditions, recent illnesses and details of any drugs and/or medication that they are currently taking. This information shall be retained by the Promoter only for the period of time that any Participants (defined below) are in the Shed, following which it shall be destroyed in a secure manner.
3.6 Based on the information provided in the Entry Form and the Panel interview, the Panel shall, in their absolute discretion, select 5 Interviewees to live in the Shed (defined below) (the "Participants"). The Participants shall be announced on air on Radio Aire on the 18 September 2009. Participants should be available for interview on 18 September 2009.
3.7 Participants must communicate any specific dietary requirements to the Promoter when they are selected on 18 September 2009.
3.8 The Participants shall enter the Shed (defined below) at 8am on Monday 21 September 2009 , and shall remain in the Shed and/or under the control of the Promoter until Friday 2 October 2009 except where disqualified or eliminated during Week 2, in accordance with Condition 3.11 below (the "Period").
3.9 Participants will be required to be at Radio Aire's premises no later than 6am on 21 September on 21 September 2009 and may be interviewed on air and photographed prior to entering the Shed (as defined below).
3.10 During the week from 21 September until 27 September 2009 (both dates inclusive) ("Week 1"), the Participants will be required to take part in activities as instructed by the Promoter, which may take place inside or outside the Shed, as determined by the Promoter in its absolute discretion (the "Activities"). Prizes may be available for the Participants based on their performance during the Activities, at the Promoter's discretion. Any Participants who fail to participate in the Activities shall be automatically disqualified.
3.11 During the week from 28 September to 2 October (both dates inclusive) ("Week 2"), remaining Participants shall all take part in one challenge per day for a maximum of 3 days as instructed by the Promoter, which may take place inside or outside the Shed, as determined by the Promoter in its absolute discretion ("Challenges"). Any remaining Participants who fail to participate in the Challenges shall be automatically disqualified. For each Challenge, the worst performing Participant shall be eliminated from the competition unless as otherwise decided by the Promoter (in its absolute discretion). Two Participants shall remain in the Shed for the final on Friday 2 October 2009.
3.12 The two remaining Participants shall take part in a multiple choice quiz on Friday 2 October 2009 which shall be broadcast live on Radio Aire and the Participant answering the most correct answers shall be the winner of the competition (the "Winner"). The Winner and other Participants may be required to take part in interviews on Radio Aire on Friday 2 October 2009 as instructed by the Promoter
3.13 The Winner and Participants agree to take part in post-competition publicity following the Period as reasonably required by the Promoter.
3.14 None of the entrants, Interviewees, Participants or the Winner shall discuss any element of the competition with any media company (including but not limited to radio and television stations, newspapers and magazines) other than the Promoter or any Group Company (defined below) of Bauer Consumer Media Limited ("Bauer") at any time either before, during or following the Period, nor exploit their participation in the competition for financial or other form of reward or payment unless express prior written agreement has been obtained from the Promoter.
3.15 For the purposes of these T&Cs, "Group Company" means any subsidiary undertaking and/or parent undertaking of a company and/or any subsidiary undertaking of any such parent undertaking.
4. THE SHED
4.1 For the purposes of this competition, the shed will be new and purchased and erected immediately prior to the Period. The shed will be 20 x 8 foot in size, constructed of wood and located outside but within the boundaries of the Radio Aire's premises. The shed will have 8 windows, 1 door (which shall remain unlocked throughout the Period), no lighting, no heating and no toilet and/or washing facilities (the "Shed").
4.2 Throughout the Period, each Participant will be permitted to a minimum of 6 x 15 minute break periods and 1 x 30 minute break period, at times as directed by the Promoter, during which times the Participants are permitted to leave the Shed without disqualification. The Promoter may at its sole discretion, permit longer break periods subject to its strict instructions being adhered to. Break periods will take place at least every 4 hours. During these break periods, Participants will have access to toilet and basin facilities nearby and will be provided with food and drink. Any specific dietary needs of Participants will be catered for provided that these have been communicated to the Promoter in accordance with Condition 3.7 above. During break periods, Participants may, at the sole discretion of the Promoter and in accordance with any instructions, be permitted to use their mobile phone or other means of communication. Participants are permitted to smoke during break periods if they wish (although they must bring their own cigarettes for the Period) on the strict instructions of the Promoter. For the avoidance of doubt, soft drinks will be available to the Participants at any time during the Period and may be consumed both inside and outside the Shed.
4.3 Participants are permitted to see visitors during the break periods but not at any other time during the Period. The Participants shall not be permitted to accept any gifts from any visitors including without limitation food and drink (even if consumed during the break periods). The Promoter reserves the right to approve visitors in advance and has the right to remove any visitors for whatever reason in its absolute discretion at any time.
4.4 Participants are not obliged to use a break period offered during the Period if they do not wish to. In this event, however, the Participant has forfeited this break period time and is not permitted to roll over any time not taken to a subsequent break period.
4.5 Any Participant re-entering the Shed later than the break period granted will be disqualified from the competition.
4.6 Each Participant will have the use of a raised camp bed during the Period and will be provided with suitable and adequate sleeping materials for use during the Period.
4.7 Participants must bring any belongings (which must only include clothes, toiletries, a towel and (if applicable) cigarettes) in a single normal sized bag or suitcase. For the avoidance of doubt, Participants are not permitted to pack mobile phones, blackberries or any other means of communication, any form of computer game, any food or other consumable items (including alcohol), books or magazines or other reading material, personal music players, sound recorders or weapons in their suitcase/bag. The suitcase/bag will be retained by the Promoter and made available to the Participant only during breaks or for medical and/or emergency purposes.
4.8 Any personal items of value which the Participant has in their possession (such as mobile phones, wallets, keys etc) shall be retained by the Promoter (but not inside the suitcase) and may be made available to the Participant during the Period as set out in these T&Cs and/or at the Promoter's sole and absolute discretion.
4.9 Whilst the Promoter will use reasonable endeavours to keep any belongings of any Participants safe and secure, it will not be held responsible in any manner for any loss and/or theft of any such belongings.
4.10 During the Period, Participants will be required to wear circulation support socks as provided by the Promoter. Any Participator who removes such socks shall do so at their own risk.
4.11 The Promoter will ensure that the Shed is adequately secured and that supervision by a qualified first aider is provided and made available throughout the Period.
4.12 Participation in the competition is entirely voluntary and no Participant shall be under any obligation whatsoever to enter and remain in the Shed and does so at their own free choice and risk. After entering the Shed, the Participants are free to leave the Shed at any time they choose although once a Participant has left the Shed and/or opted to abandon the competition, they will automatically be disqualified and will not be permitted to re-enter the Shed and/or competition.
5. PROHIBITED ACTIVITIES IN THE SHED
5.1 During the Period, whether in the Shed and/or when engaging in any Activities or Challenges, a Participant shall not:
(a) engage in any behaviour (either through words or conduct) which is inappropriate in the sole opinion of the Promoter, including but not limited to behaviour which is threatening, sexual, racist, anti-social, indecent, defamatory, slanderous, obscene or offensive;
(b) do or say any thing which is in the sole opinion of the Promoter derogatory or damaging to the goodwill and/or reputation of the Promoter or Bauer or any of Bauer's group companies;
(c) act negligently or recklessly in respect of themselves or any third party (including the Promoter and its employees and/or other Participants);
(d) disconnect or interfere in any way with any audio, camera or recording equipment or other similar equipment supplied by and/or installed by the Promoter;
(e) make use of mobile phones, pagers, or any other method of communication (except where this is explicitly permitted during break periods as detailed above);
(f) use personal or portable radios, ipods, CD or other music players;
(g) use any recording equipment of any kind which has not been provided by the Promoter;
(h) play a musical instrument of any kind unless given express permission to do so by the Promoter;
(i) consume any food or alcoholic beverages outside of the break periods (except as otherwise provided by the Promoter, on the Promoter's strict instructions) with the exception of chewing gum and sweets as provided by the Promoter at its discretion.
(j) play any computer game of any kind;
(k) smoke cigarettes (except where this is explicitly permitted during breaks as detailed above);
(l) make use of any personal comfort items such as pillows, blankets, cushions, duvets or anything similar (except where such items have been provided by the Promoter, on the Promoter's strict instructions); or
(m) open the door of the Shed other than on the strict instructions of the Promoter, during permitted breaks or in order to exit the competition (in which case re-entry will not be permitted and the Participant shall be disqualified from the competition).
5.2 The Promoter reserves the right in its sole discretion to disqualify any Participant with immediate effect at any stage during the Period and/or the competition where:
(a) that Participant has contravened any of these T&Cs;
(b) the Promoter has reasonable cause for concern regarding a Participant's medical and/or psychological state; or
(c) the Promoter believes it is in the best interests of the Participant concerned and/or the other Participants and/or any third party (including the Promoter) for the Participant to be disqualified.
5.3 In the event of disqualification outlined above, the Promoter will not be responsible in any way whatsoever to the Participant and is entitled to source a replacement Participant (to whom these T&Cs shall apply, for the avoidance of doubt) if disqualification of a Participant has taken place before 9am on Monday 28 September 2009.
6. LIABILITY
6.1 The Promoter excludes any and all liability whatsoever and howsoever arising (except for liability of the Promoter in relation to death or injury to the Participants (or other entrants) as a result of the Promoter's negligence or the negligence of the Promoter's employees or agents) as a result of or in connection with the competition howsoever arising. All Participants and Interviewees agree and accept that their participation in the competition will be at their own risk without any recourse whatsoever to the Promoter save as expressly provided herein.
6.2 The Promoter gives no representation or warranty, express or implied, regarding the condition and/or fitness for purpose of the Shed in respect of the competition.
6.3 The Promoter cannot be held responsible for the failure of any third parties to comply with their obligations included in these T&Cs. Each Participant shall remain solely and fully responsible and liable for his/her acts or omissions during the competition and/or the Period. Each Participant shall indemnify and hold the Promoter harmless from and against damages, costs, expenses, claims, losses and any other liabilities arising as a result of any acts and/or omissions of the Participant including but not limited to damage caused to the Shed, damage to other premises and/or materials (whether belonging to the Promoter or a third party), damage or injury to any third party (including the Promoter and its employees and/or agents and other Participants).
7. RIGHTS OF PROMOTER TO USE IMAGES AND QUOTES OF ENTRANTS, INTERVIEWEES AND PARTICIPANTS
7.1 Entrants confirm that the Promoter and any Bauer Group Company can use their name, age, appearance, voice, likeness and any other details provided on their Entry Forms for the purpose of promoting and running the competition in any media (including on the radio and the Internet). The entrants acknowledge that no sums shall be payable to them by the Promoter or any Bauer Group Company for such use by Bauer.
7.2 Any entrant selected to be an Interviewee and/or a Participant shall, at the Promoter's request, provide the Promoter (or, at the Promoter's election, any Bauer Group Company) with all consents, licences, assignments and waivers necessary for the Promoter or any Bauer Group Company or other third party to fully exploit the material created during the Interviews and/or the Period (the "Materials") in any and all media throughout the world without restriction (including to advertise and promote the competition). The Materials may include (but shall not be limited to) photographs, film and video footage and voice recordings which feature the Interviewees and/or Participants in any way (including their appearances and voices). For example, the Promoter may decide to use clips from the Interviews on the Promoter's website or in a TV commercial. Failure to provide such consents, licences, assignments and/or waivers as required shall result in the Interviewee not being selected as a Participant in the competition, or a Participant being disqualified from the competition.
7.3 The Interviewees and Participants hereby confirm that nothing they shall say or do in the Interviews or in the Shed shall infringe the copyright of any third party.
7.4 By entering the competition, the entrants, Interviewees and Participants agree that the Promoter and any Bauer Group Company may use their personal details in the course of running the competition as set out in these T&Cs and for related purposes such as promoting the competition on Radio Aire and in Bauer publications and announcing and publicising the winner. Details of the Participants' state of health and medical conditions shall only be used to monitor the health of the Participants whilst in the Shed and to provide any medical treatment as appropriate. Such information shall be kept strictly confidential by the Promoter and only disclosed to those people responsible for ensuring the health and safety of the Participants during the competition (including professional medical advisers where appropriate).
8. PRIZE
The Winner shall be entitled to one of the following prizes upon provision to the Promoter of evidence of the mortgage or rental payment schedule (as applicable):
(a) If the Winner has a mortgage, the Promoter shall pay the Winner's monthly mortgage payments for one (1) year up to a limit of £5,000 in total. The monthly mortgage payment to be paid by the Promoter as the prize shall be based on the average monthly payment made by the Winner in the 3 months prior to the Deadline. The 12 monthly payments to be made by the Promoter as the prize will not be subject to adjustment in the event of an interest rate rise, which increases the amount payable by the Winner to his/her mortgage provider. The Winner will be responsible for paying any shortfall between the monthly payment made by the Promoter and the actual payment due from the Winner to his/her mortgage provider.
(b) If the Winner is renting a property, the Promoter shall pay the Winner's monthly rental payments for one (1) year up to a limit of £5,000 in total. The Promoter shall pay only the rental fee which shall exclude utility charges, service charges or any other charges. The monthly rental payments shall only be paid in respect of the property being rented by the Winner during the Period and shall not be rolled onto a subsequent rental property unless otherwise agreed in writing by the Promoter, in its sole discretion. The Winner will be responsible for paying any shortfall between the monthly payment made by the Promoter and the actual payment due from the Winner to his/her landlord.
8.2 Arrangements regarding payment of the prize will be agreed between the Promoter and the Winner. The Winner agrees to provide all necessary cooperation and information required to finalise the arrangements regarding monthly payments of the prize.
8.3 Prize is as stated, is non-transferable and no cash alternative is available. No alternative prize will be awarded in the event that the Winner (as applicable) (i) pays off their mortgage; or (2) the lease in respect of the Property being rented by the Winner either expires or is terminated, before all 12 monthly instalments have been paid by the Promoter. The Winner will not receive a further payment for the difference where the total of the 12 monthly mortgage payments or 12 monthly rental payments covered by the Promoter is less than £5,000.
8.4 The Winner will be bound by any terms imposed by any third parties providing their services as part of the prize.
9. GENERAL
9.1 Each entrant agrees and accepts that the Promoter's decision at every stage of the competition is final and may not be challenged.
9.2 The Promoter reserves the right to change these T&Cs and to alter any aspect of the competition and how it is run and managed at any time before or during the competition in its entire discretion.
9.3 There is no obligation on the Promoter to broadcast or publish in any way any footage or materials produced or collected during the competition.
9.4 The Promoter reserves the right to cancel, amend, terminate or temporarily suspend the competition at any time (including during the competition) in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or Participants or third parties.
9.5 The Winner's details (name and county) will be available for six weeks only by sending a SAE to Peter Foster, Radio Aire Limited, 51 Burley Road, Leeds LS3 1LR.
9.6 This competition and these T&Cs are governed by English law and subject to the exclusive jurisdiction of the English courts.0 -
