Refurbished TV - Return rights help!

Hi all, I have read a lot of the forums over the past couple of years and of course have been receiving the weekly emails :D

I now have an issue that I hope some or one of you may be able to help me with, it's to do with my rights as a consumer to return a faulty product - note that to make this more complicated, the item is refurbished.

I purchased a refurbished Samsung 40" LCD from a warehouse clearance sale held at Ebuyer on 11 July.

The LCD is displaying signs of a fault, intermittently the
display shows green shimmering lines within objects, there are
also large areas of yellow clouds within lighter areas.

This problem is not happening all the time, though it is becoming more
frequent. It is also not dependant on input, i.e. it happens with HDMI
and SCART sources as well as with the DVB and analogue tv tuners built in.

I wrote to tell them about this on 08 September, and their reply was the following: -

Dear Nick Gale,

Thank you for your contact with our Customer Support Team.

EBuyer did not offer any warranty with the clearance products. Please
contact Samsung therefore for assistance.

The manual supplied with the tv has a sticker on the back: -

!!NOTICE!!
This is a refurbished
Samsung Product.
After service is
provided by the
purchased place,
not by Samsung.
Koambra-EU Kft.

Can anyone suggest where I go from here???

    Warranties are in addition to your statutory rights, and cannot take them away.

    You have recourse against the seller,(EBuyer), under the SoGA, it makes no difference that the product is refurbished, it should still be of merchantable quality and fit for purpose, seeWHICH.
    Don`t steal - the Government doesn`t like the competition

    I suspected as much and have put a note to them saying basically, that as far as I am concerned the lack of a warranty is irrelevant as the item is not fit for use as described under SoGA. I await their reply and will let you all know what the outcome is.
