Currys - sat nav - independant engineers report - Help please !

i had a rather long ongoing issue with a TomTom 520 sat nav with both TomTom and Currys.

Following previous advice from here, Which and my own research, i contacted Currys as the retailer with the complaint about my faulty sat nav....very briefly exact same fault as what was repaired under warranty after 1 year happened again just after 2.5 years of ownership, wont work at all, TomTom wanted fee for repair, original cost £359.

Used sale of goods act quotations and reasonableness i.e. £359 to 2.5 yrs usage etc and have now got a response frm Currys HQ asking me to get an independant engineers report which they will reimburse me for if claim successful.....stating nature of fault, likely cause, how to repair and cost to repair.

Well, firstly, i have no idea who would be able to do this for me, i have searched locally, no joy, seen adverts on internet for London companies who seem to want approx £65....

secondly, are Currys just trying to make me give up (there has been lots of issues before getting to this stage that are irrelevant to this thread)...i expect they are and am wondering if this is all worth my time and effort.

I have since purchased another sat nav as one is pretty essential to us, so dont want this repairing but would like some compensation...i did state this in my communications with Currys......

    You probably already know this -- from Consumer Direct website.
    If you make a claim for a repair or replacement of faulty goods within six months of purchase its up to the seller to prove that the goods were not faulty when sold to you. After six months you may be asked to prove that the fault has not been caused by accidental damage or wear and tear and you may want to obtain an independent expert’s report to back up your claim. However independent reports can be costly so before you get one it is important to discuss your proposals with the trader and if possible get prior agreement as to who will cover the costs.

    According to this, Currys do seem to be within their rights to ask you to get an independent expert's report, and you say they've already said they will pay if the expert confirms the fault. But you can't be sure the expert will confirm the fault, so if it was me I would think long and hard about whether to risk the extra spend.

    thanks Chloe - i am pretty sure they would confirm as Tom Tom have had the sat nav back and they told me it was the same fault as before.

    The real problem is i guess for me finding somewhere / someone who will diagnose locally....

  • I have already - they said they couldn't advise / help me !!

    I am still searching before writing to currys again....
