HELP urgently needed please

hi everyone
hope someone can help me out...
i have applied to santdander to have my charges refunded (approx £930 on a debenhams card). the account was opened in 1996 and closed in 2008, i have recived a letter today stating they cannot and wil not refund any money to me to me as i took the agrement out before the FSa ruled the charges were unfair. any advice would be grealty appreciated, as i felel like giving up!!!! does anyone if this advice is correct or is it a "get out of paying excuse"

Do you mean PPI or Credit card charges?
