Financial crisis - lloyds tsb say i must await test case

I first contacted Lloyds TSB on 18th June 2007. Like thousands of others, I received a letter to say everything was on hold until the test case. I grudgingly accepted that I'd have to wait until I saw on this site and on TV, Martin talking about the exceptions to this if you were experiencing financial hardship. So I wrote again to Lloyds in June this year and enclosed another £10 - I used the letters on this site. I received my statements (which I'm not wholly convinced about). I then rewrote in August (again using one of MSE letters) asking for £2073.22 plus interest of £165.84 to be repaid.
I have now received a reply to say that I must wait until the test case with the Office of Fair Trading.
What now? I have 4 children and I am in a low paid job, I really could do with this money. The MSE site does not explain what to do in this circumstance. Can anyone advise? Thanks

But do you have priority debt arrears(mortgage/rent, council tax, utilities)?realduchess wrote: »I first contacted Lloyds TSB on 18th June 2007. Yes, all of the above. Lloyds didn't ask for evidence or seem interested in any of this though.0

Did you outline everything in your letter and send a copy of your income and expenditure sheet ?
You need to write again outlining what effect the charges are having on you and the effect a refund of some of the money would have on you. The charges need to have been incurred immediately leading up to or during the period of hardship to be in with a chance of being refunded. Remember hardship is almost seperate to the legal bank charges claim, its more a complaint that they are not treating you sypathetically while you are in hardship.
If you want any help with letters or your IE please feel free to ask.LegalBeagles0 -
I will write again and list some areas where I've been affected: missed mortgage payments, cancelled house and life insurance, utility arrears etc0
