section 21 of the housing act

    What ever you do, dont let this stupid landlady boss you around and get around the law.
    I would take further advice if they try and produce a backdated section 21 notice.
    Stay firm. Get more advice from the CAB if you need it. She sounds like a bully if you ask me. If you show that you know what your talking about then she will not rid rough shot over you.
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • Landlady is a twit & giving decent landlords a bad name. I'm sorry for your experiences. Hope it gets sorted.

    As she's not protected the deposit the S21 (if it comes) will be invalid. And you can sue her for deposit & 3xdeposit (!) as she hasn't protected it..

  • The landladys son has just been and given me my section 21 finally she has seen sence dated 18th sept for possesion after 19th of november.
    Will keep you posted on the progress, nothing about the deposit but never mind maybe i will be in for 3x
  • Do you know, I sincerely hope you do considering her lousy behaviour and attitude. I wonder how long it will be before your charming landlady realises that her precious S21 is invalid.
  • I now she gives LL a bad name about 15 years ago i was with a private LL he was fantastic anything that needed doing he did it no matter how small. When i moved out he came round asked me if i had rubbish to bag it up and he would take it (saving waiting for the bin men). As for the deposit he gave me it in the garden as i was leaving not even stepping foot in the house i could have left a right mess. Lovely bloke it has not so much put me off renting private but would check out everything first speak to neighbours and previous tenents.
    When i seek legal advice next week i will ask about slipping in the court order for deposit just before i leave say the begining of nov.

    I dealt with i think it was a tenancy relations officer at the council who instead of phoning my LL put everything in writing to her and copied me in to every letter.

    I was actually issued with 3 section 21 notices all of which were invalid due to the wrong dates on them!

    This was at the end of a 12month tenancy this started, in the end i was there for 3 and a half years and left of my own accord into another private rented accomodation where the LL and agents were absolutely brilliant.

    I know how hard it is especially when you have little ones (I had 2 and the age of 2 at the time!) but please try not to worry until her S21 notice is valid she cant do anything and if she does attempt to then it is an illegal eviction and you can call the police.

    Please as you have been previously advised change the lock barrels on all doors though, to protect yourself your children and your belongings from a potential illegal eviction, you are not doing anything wrong as long as you replace it with the original barrel before leaving the property.

    I hope this all goes well for you. If the dates on the section 21 are 18th Sept for possession on 19th Nov, then her solicitor has got the dates incorrect. You have to be given 2 months notice, and if the section 21 was served on 18th Sept the end date should be 17th November, not 19th. Also the notice has to be served before the first date 18th Sept. By serving you the notice today also makes it invalid.
    Speak to your solicitor, dont speak to your LL about this, it is her problem that she and her solicitor have not got it right.

    the dates look ok to me - a LL has to serve a Minimum of 2 months notice

    She's obviously rude, arrogant and very, very stupid. It sounds like she's got a S21 form from WHSmith but hasn't read up on how to serve it correctly. This could go on and on for ages. I'm off to sign up to a subscription-service for popcorn.

    OP, please pay attention to the recommendation that you change the lock barrels right away.

    Clutton: the S21 was served today but dated yesterday. That can't be correct can it? You can't serve a S21 retrospectively, can you? And the miserly old bint hasn't mailed it by recorded delivery so unless half the street were there as witnesses, she won't have any proof it was ever delivered.

    but what i did spot is that the tenancy started on 25th of the month in OP post#1 so all of the dates on this Section 21 are wrong anyway !!!
