I will keep looking but just in case I have got confused hayley, keep at them, and I wish you luck.

I will also check other sites as well, just in case.;)
Yeah thanks for that Di. Will be glad to know that also. I know I have posted in response to every single Bespoke claimer and never heard anything back from any of them. I do check to see but will be glad for you to check other sites too and post back for Hayley.;)

I bet all the Bespokers want to know this information Di. Just seems they never post back.

    Not a problem Marshallka.;)
Will have a browse around, although I can't promise anything.....:o.
So would it be a case of pursuing through the actual insurer then?

Its up to FOS as they class each case on merit. Its always worth a try. I had so many complaints with mine and lots of descrepancies. There were an extra 40 months added to the loan cause of the PPI and also the wage address was wrong (all of which I have proved to FOS). FOS can only do so much but like I say, if you have a strong enough case and put forward a strong enough argument (mine is for unfair rebate) then they MAY be able to help although unfair rebate is only a smiggen of what you would get back but it all helps.

Seems like most have gone to the lender for the rebate side of things then, maybe somewhere down the line is where my confusion came into to,
"what am I like"? lol :o

Same here on CAG by the looks of it:

  • Thanks Guys! I know that this is going to be slog - even though it has already been a slog for the last 6 years!! I contacted Consumer Direct today and they are going to refer to Trading Standards. I will also go, as you advised, to FOS and FSA. Will keep you posted!
  • Because the claim is for over £5,000 (without the interest) - then you could easily approach a solicitor and ask them to act for you on a Contingency Fee Arrangement (CFA) basis - basically this means that if they think there is merit in your claim they will take it on and they can charge the other side for all their costs - so it won't cost you anything!! - Then all the hassle & worry is taken out of your hands... Don't go to any company who charge because you really don't have to!
:AIgnorance can be cured, but stupid is forever!:A

  • Thanks Paulin Weston! Thats good info!
  • Shockerooni! We have received a FINAL response from Bespoke telling us to beat it. I have emailed the FOS and am awaiting their response re; the next course of action - maybe the Gods will look down favourably on Mr & Mrs Jaffrey and the FOS will kick Freedom & Paragons butts!! I live in hope!

Otherwise, I need to find me a smart, knowledgeable and capable solicitor who is prepared to be inventive and proactive in getting my money back!!

    Jeez Lou-eez!!

I take it your loan was pre 2005 then? This is when Freedom will state Bespoke sold it and then after FSA regs they will accept with Freedom. I would just explain to FOS about Bespoke being in GIB and Freedom not taking responsibility for it (saying it was Bespoke) although you believe that the sale of the Insurance took place in the UK so how do you stand? I don't know the date that Freedom came under the FOS jurisdicition or Paragon but just state that you feel that someone of the trio SHOULD take responsibility.

Have you made your complaints to the FSA and OFT etc about them yet? You would stand a better chance by doing this and stating this to the FOS too as you had a restricted statutory protection at the time of the loan and PPI being sold as the laws are different in GIB. All three would have had CC Licences so the OFT maybe able to help or at least hear you out.

Let us know how you get on here.
  • Hey Marshalka
Just wanted to let you know that I have "re" complained to FOS and have also sent a complaint to the FLA - Paragon were regulated by them at the time of the loan. Will see what happens with those two before I move forward.
