private number plate query ??

hi my hubby went bankrupt a few weeks ago, we have a private number plate on the car but its not ours its our 3yr old sons ! My son has the same initials as his grandad and he said when he was born that he wanted him to have his private number plate that he has had for about 20 years !! Anyway last october he decided to give it to us to keep it for him and said we can put it on our car, which we did, so its been on our car since then.

It is not in my husbands name, its in my sons name and my husband is a nominee, we have tried ringing the DVLA loads of times for proof that it is not my husbands but they cant provide any ! We are now unsure what we can do because the plate is probably worth around £12,000 and we dont want to lose it to the receiver, anyone have any ideas on what we can do ??

I know it may sound a bit dodgy to some people and that we are trying to keep assets etc but back then we was finacially ok and had no idea we would be going bankrupt this year or else we would never had put it on the car !!!

  • As far as i am aware the plate belongs to the car unless it is on retention, if on retention it belongs to a person or rather that person has a right to use it.
    For this reason the OR should take note of the cars value including the numberplate.
    I too have a private plate and no idea how much it is worth, we only paid £250 for it 5 years ago but if you saw it you would think it was worth much more. However, we bought the rights to the plate when i bought the interest in my car.
    I would not normally advise this, but i would not mention to the OR that it is a private plate it is obvious the sentimental value is worth so much more
  • have you been able to find out how much it will be to transfer it to another car in the family? surely if no money changes hands and the car goes back to its original plate then they couldn't say anything - especially if you can show that you did not buy the plate in the first place?

    sorry no expert on bankruptcy but it may be worth a go??

    You never own the plate and as above its part of the car unless on retension.

    Why can't you just put the plate on retension under your sons name ? transfer it to another car ? or am I missing something ?
  • Can we put the plate on retension now ? He went bankrupt last month so will it not be classed now as an asset ??

    Would a letter from granddad prove that your husband does not in anyway own the plate - and that it does "legally" belong to your son?
  • Surely "legally" though it does belong to your husband as it is on the car that he owns and a cherised plate belongs to the car, even if your/hubby's father meant for it to be for your son, legally it belongs to husband ? A bit like if I buy a car, and register it with me with the DVLA and on the log book etc, but my brother is driving it and we both consider it to be his, legally it's actually mine still?

    Sorry I may be looking on the negative side, but can see the OR wanting an easy £12,000 (they hauled me over the coals for mine, which wasn't worth very much at all and only had sentimental value really). I didn't declare it as a cherised plate when I had my interview as I didn't think of it as an assest as it was 10 years old and as I say not really something that anyone would think of as a cherised plate, however my OR noticed it was one, so charged me for it. On the flipside I think there was someone on the boards who had one, didn't mention it, and didn't get charged for it, so fingers crossed....

  • my plate is worth, well valued by a company at £1000, i tried to sell it before BR FOR £300 - no interest, its only worth something if the combination of numbers and letters mean something to someone.

    The OR let me buy my plate back for £20 lol :p
