Reclaim PPI.Employed & self-employed.?

Hi Guys,
Hope someone can help me.
I took out an unsecured loan with Halifax in September 2005.I was sold PPI on this.
At the time I was employed part time (18.5 hrs) and the rest of my income was from Self-employed work.
I have read on the boards that PPI would not pay out for part ime work or self-employment.
Could someone please clarify this for me as I am thinking of putting in a claim for being mis -sold this product.
What do you think?

Thanks in advance

    Hi there Mollypolly

I would check your terms and conds of your policy as they vary from one to another. If you no longer have these ask your bank to provide them to you.

Some will cover as from 16 hours per week and some also protect for self employment, but worth checking just in case.

If you find that you do have a case due to the above reasons then go for it.
For more info check this link here below, which is Martin's useful guidelines of reclaiming:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

However, you may have other reasons that occur to you, check the mis selling checklist in the above link and please post back for help if required.
    Good luck.;)

    Hi Di,

    Thank you for the reply.

I don't seem to have any terms and conditions...just a sheet of keyfacts .The policy seems to cover Life/critical illness, disability /everything really .
Re unemployment it says we will pay you unemployment benefits up to a maximum of £3500 for up to 12 months. No mention of part time or self employment.
This loan was done over the telephone and sent to me for signing by courier.(all done very quickly and I don't seem to remember being asked too many questrions about all this insurance).
How can I get a copy of the Terms and Conditions.
(I should say that I never throw anything away:o so Iam surprised I have'n't got this.

Once again thanks for any help guys.

ETA, It does state at the bottom of the letter which the courier bought...If you have included insurance cover, it is particularly important that you check that you are eligible to be covered under the policy, you do have the right to cancel it and information about this right and eligibility is provided in your policy booklet.
So maybe I did have one.
Does this put them in the clear re any mis-selling.

Hi hun, I would ring them and ask that they provide these to you, tell them you do not have them on hand, they should post these to you, or check them out on their website.

Another suggestion as well, if this sale was made over the last 6 years over the telephone, it maybe a good idea to ask if they could supply you with a copy of the phone recordings.

You could though before you make a start is to request a Subject Access Request (SAR), where they have 40 days to comply, but there is a charge of £10 cheque or postal order for this request.
They should provide everything they hold on you and maybe the terms and conds will be within the SAR, it us up to you, if you decide to SAR here is the link to the template letter here:
    http://forums.moneysavingexpert.com/showthread.html?t=1475553

    Hope this helps for now.

Many have had PPI automatically added without their knowledge or assumed it was all part of the finance, I used to think it was.
So if you have checked the checklist of mis selling reasons and any of those other reasons also occur to you, then you have a case anyway.;)

  • Hi Di,

I was adding an edit to my last post when you posted.

Could you just have a quick look for me.Then I think I may go for the SAR and hopefully get a copy of everything that they have.

Also we have the mortgage and current account/overdraft with the Halifax...do you think me doing this would affect them in any way.Don't want them taking away the overdraft LOL.

    Thanks again

Just read it now and I would not worry about that, that is standard, they probably did provide you with them, but if your like me I mislay these things lol :o, but not to worry.

It is known they send these out after you have signed up anyway, but yes maybe a SAR would help, fingers crossed and take it from there.

It will not affect other credit you have with them, your only rightfully reclaiming what is yours that you have been out of pocket for.;)
    And your welcome.
