Landlord Bankrupt and my deposit is not secured

Hi,

I have some one turned at my flat claiming my landlord is bankrupt and was arrested. They changed the locks for the property and gave me a new set of keys and told that I need to pay the rent to the receiver going forward.

1) I have paid 1 1/2 month deposit to my Landlord and he has not deposited in any scheme
2) I am planning to anyhow vacate the property in 11/2 months.

Can I adjust my rent against the deposit. How will I make sure that I get my deposit back. Secondly, there is no contract signed or inventory signed.

Any advise will be gratefully received.

  • I doubt you will be able to avoid paying the rent to set it against the deposit you paid.

    I imagine you would have to be listed as a creditor and given the ammount owed you'll be right down the list to get your money back.

    I may be wrong but that is what I think is the case. Hopefully you will get a more certain answer shortly
  • That seems a bit unfair if the receiver can assume responsibility for collecting rent while failing to assume responsibility for refunding the deposit?

    Something is fishy; you don't get arrested for being bankrupt.

    I agree that this doesn't sound right. Do not do anything at all unless you hear from the official receiver. Bankuptcy is not a criminal offence, and you would not be arrested for being bankrupt - arrest is part of the criminal not civil procedure.

    What if I turn up now down the road and do this to a neighbour ... once I see them go to work tomorrow I could turn up at the house and let myself in with the spare set and clean them out.

    Just a cheery thought.

    If a receiver takes over as the LL they become responsible for the deposit - but this doesn't sound like a real receiver - any paperwork?
  • Well I'm glad other people did respond because I totally missed picking up on that point.
  • What silvercar says. Don't pay any rent until you have proof of who is entitled to it. Check out with Landlord what is going on, but do keep the rent unspent so you can hand it on to whoever turns out to have the right to it.

    Better still, ask someone to come round with new locks so you don't have to leave the house unattended. This sounds like a right scam!
