Ending a tenancy...

Hi guys, my Dad has lived in private rented accomodation for 3+ years and has now been offered somewhere much nicer and cheaper.

He has to put it in writing that he wants to end the tenancy, but does this have to be done in any particular way or by any particular date?

Could anyone help with the wording of the letter please, he's asked me to type and print one out but my head isn't working straight at the moment!

You haven't provided sufficient information for anyone to answer you because it depends on the type of tenancy that your father holds.

If he has a current contract, what is the fixed term or what notice period does it stipulate? Did he once have a contract that expired and no further contract was subsequently signed (i.e. it automatically became a periodic tenancy)? If so what is the date that the contract start?

    Sorry, it's a months notice.

He moved in, in June 2006 and only had the one contract which has ran since then. I'm not sure if he knows the exact date though, but I'm sure he can have a dig about and see if he can find the tenancy agreement.

It's just that I'm sure I've read on this board before, that notice has to start at a certain time (day rent is due, is it?).

His rent is due on a Monday if that helps?

  • It sounds like he is now on a monthly periodic tenancy. He will need to give a months notice starting from a monthly pay date and expiring on the next pay date a month later.
He can submit the notice however at any time in advance of the start of the notice period ie write now saying "I wish to give a month's notice from xx date, and will be vacating the property on YY date."

Thank you. Does it make a difference if his rent is due weekly?

4 weeks notice rather than a month.
