house sale and no maintenance payments

Hi,

I seperated from my husband 18 months ago and live in the house jointly owned by both of us. My ex husband does not pay me any maintenance as he was made redundant 4 months ago and I pay the mortgage and all the bills myself.

I hope to stay in the house until my son leaves college in 2 years time. Will my ex husband have an equal share in the equity in the house when it is sold even though he has not contributed to it.

If he is has joint ownership then yes he is entitled to half. If the mortgage is still in both names then both parties credit ratings will be affected by any missed payments etc.

You need to look at either buying out his share of the house or coming to a legal arrangement with him to take over his equity. You need to speak to a solicitor and your bank about getting the mortgage transfered to you but the bank will want to make surte you can afford it in their eyes. It also depends on the amicability of your ex.
