hi there, received same response from same lender. I replied that I did not recall ticking any such box and would issue court claim if they refused my claim. Offer 'goodwill gesture' as they call it since received and accepted. Stick with it!Hi,
I took out an Egg CC in 2003. Am I right in thinking that pre 2006, the PPI box may have been pre-ticked? I will submit a SAR but unsure quite how you would prove that?
Has anyone had any joy with claiming against Egg under these circumstances?

FInally, someone else who suspects the PPI box was pre-ticked!
I have made two compaints to Egg, initially via phone, and I specifically mentioned a concern about the box being pre-ticked. They wroteto me within a week saying, "sorry, your fault...blah blah blah". They included a screenshot of their computer screen saying, "look, this box here says you have PPI, if you'd left the PPI box unticked, it wouldn't say this would it?!"
This was about a much use as a chocolate teapot proving their side.
So I wrote back, putting more emphasis on the fact I suspected the box was pre-ticked and/or had suspect wording which led me to believe it needed to be ticked.
They wrote back saying "no, you're still wrong, it's your fault etc etc, and just to shut you up here's a screenshot of our website and the PPI box that you have to tick, so stop writing to us!".
What they seem tohave failed to address both times is that I wanted them to show me that i'm wrong, that the box wasn't pre-ticked, but they failed to do this, so I'm going to shove the FOS up their posterior, and hope it gives them a PPI enema so to speak...
Egg sent back a copy of the screen print of my online application, which showed my name, address, bank details, employment etc. But what it did not show was anything to do with PPI. That is until you look further down, at the bottom of the screen print was an ‘for internal use only’ type section which they obviously uses to mark your credit scoring, credit limit etc. In this section there was a text box stating Payment Protection amongst other things.
So I wrote back to Egg saying that an internal manually edited text box is not proof that I ticked the box.
Egg response was their usual standard put off reply, so I went to the Ombudsman who evenutally I heard back from saying that Egg have agreed to repay my PPI :j0 -

This is exactly what I said to the FOS in my letter, still waiting to hear, but looks like if a precident has already been set, I might well be in luck!!

Did you get anywhere with your claim with Egg? I'm just awaiting a response from them to my first SAR letter, applied for my loan online back in 2004 when the pre-ticked box was around.
