The dreaded Egg!

I (finally) got Egg to admit selling PPI and they agreed to repay me £4800 BUT like so many others they credited the entire amount to my loan balance despite having no arrears and having missed no repayments in the entire term to date. I referred to FOS and also wrote to Trading Standards, FSA, Watchdog and loads of other consumer champs (decided on landslide approach!) Am still waiting, latest is FOS gave them till 7/9/09 to respond to them and they haven't as yet and Trading Standards rang me today to say that they totally agreed that the repayment should have been made to me to put me in a position as if I had never taken PPI and that by crediting my loan Egg have changed the terms and conditions without authority or discussion and this was unlawful. Unfortunately though they wrote to Egg ages ago they have heard nothing and Egg are resolutely refusing to speak to them on the phone - refusing to speak to me too as saying it's in FOS hands now and they will only deal with them (even though they're not replying to them either!) Question: has anyone been successful in reversing Eggs decision to refund missold ppi this way or am I just wasting my time? Everyone seems to be saying "they can't do that" but I can't seem to find any way to get them to even acknowledge that, let alone do the right thing! Someone give me hope..... please!..:confused:

    Hi there Rach

    Sorry to hear of this your going through.

    I am aware that EGG can be difficult and many are still waiting and have been waiting months for the reclaims to be sorted out.

    If you have not done so yet, let the FOS know that you have also made contact with other parties, such as the Trading standards, so they have records of this, in case they have to contact EGG.

    Unfortunately, it seems that more banks are dealing with these refunds like this now, I don't agree with it either, of course unless there are arrears etc, but in your case there isn't and you have been out of pocket due to this.

    I am sure it will be resolved soon, and fingers crossed it will be soon, I hope it all goes your way.
    We will also appreciate it if you could keep us posted on this matter, so that others in your position can also fight this as well.

    Hopefully others who have been and are still dealing with these will post up as well shortly.

    I am so glad you have done something positive about what Egg have done and wish you all the luck in the world on this. I posted to you and others ages ago stating that i could not see how they can get away with changing the agreement terms etc without your signature and agreement in it. You should also have the same rights for this to be fair as they are giving themselves rights that far outweigh your own. (unfair terms in consumer contracts 1999) although I bet there is no-where in the actual contract that says they should be allowed to do this. I think if you carry on fighting you should have a good case and win. Let us know any outcome and just keep on at FOS and if needs be get them to take this higher to the Ombudsman and not just an adjudicator. If no-one carries on about this and accepts this then they will carry on getting away with it.

    The only time this is actually fair is if there are arrears on the loans or have been missed payments at any time as they would be within their right then to recoup the money.

    Thanks very much guys, certainly won't be giving up anytime soon and will keep you posted!! Have told FOS about Trading Standards involvement and also sent stern secure message to Egg yesterday confirming Trading Standards have my authority to speak to them, and also asking why they are not responding to FOS. Watch this space.....

    I have a claim with the FOS for the same reason, mine's been there
    since March not yet reached an adjudicator, how long did yours take to get to an adjudicator?

    Not heard of anyone having any success with getting the actual cash yet.

    Whoo - Hoo! Just got a letter from FOS saying they have got Egg to agree to repay me the money directly to my bank account and restructure the loan as if ppi was never added. Can't quite believe it after all this time and will keep the champers on ice till the money actually arrives!! Happy Days!:beer:

    Well done, that gives me some hope.

    How long did it take from submitting to the FOS to getting to the Adjudicator?

    First reported to FOS in July after Egg had already put their hands up but had credited what was owed to me against by remaining loan balance. Has taken 4 months approx for FOS to sort but boy is it worth it!!
