sar reply not impressed

a while back on here i posted

"i took out a loan with the RBS back in 2004 20/01/2004 - 29/01/2007 (dates according to experian)

problem is after the term of the loan i shredded all account details

went down to my local branch of RBS to try and get the account number but have been told that without the account number they cant pull any details!

is there any way i can get them from the RBS as surely they must have the details? failing that is there any way i can claim

im still living in the same house and have the same current account all payments came from so surely there must be something i can do

to which i was advised to write the bank a sar request using the template which i did and today received the reply from the bank

now in the last 6 years iv had 2 credit cards 2 loans and have 3 bank accounts with them so surely they must have more than just that? also its not made me any closer to finding out the loan details

help!!!!!!

    Hi there

    Just a thought to same me searching through older posts, but other than the SAR,m have you actually wrote to them to just request for the Agreement with the payment of £1 postal order or cheque payment.

    If not write to them to request a true copy of your agreement, give them your personal details as you state that everything is still the same, address etc etc, and enclose the payment as confirmed, and tell them you look forward to receiving this by 12 days of requesting this, post by recorded delivery, this is safer and your proof of posting.

    Unfortunately an SAR does not always enclose the agreement, as you know as well the details of your finance is disclosed on the agreement, so due to this I would request this anyway as suggested above.

    If they cannot supply it they must return your payment with an explanation of why they cannot do this.

    However, if you have reasons for being mis sold, then go for it.

    It may be the case that when you do write to complain, that they will then send you a copy of your agreement with their decision anyway, so in this case then you will not have to pay anything.
    Just as long as you have the account number for the complaint then that will do.

    For more information, a checklist of mis selling reasons, also templates, that you can use or just as a guide, obviously with your reasons, write to them by giving them 8 weeks to respond.

    They may write back and not resolve in the first stage, but by giving you the opportunity to write back to them for them to reconsider, so basically keep at them until you receive the final decision, which should also enclose details of the financial ombudsman service (FOS).
    You can or should be able to take your complaint to these if your not happy with the outcome.

    Again, post by recorded delivery - for your proof of posting.

    Also just to clarify that you do not need to write the amounts on the letters at this time.

    Did they take the £10 payment for this? If they did and you have this in writing then I would now make a complaint to the ICO about this. ALso write back to your bank and state you have now complained to the ICO (Information COmmissioners Office). They should have given you the whole of your records (including agreements) in a SAR request and they clearly have not.

    Just state that you need a complete SAR from them (IF YOU PAID THE £10???) and what they have sent to you does not constitute one as the agreements are missing. I am still unsure what you actually sent to them in money for the last one? If you only sent them £1 then this would not be enough money to actually get a SAR and this would only be to get an agreement from them (although they have not sent you any anyway).

    Hi there.;)

    As Marshallka also said, the £1 will cover the agreement request only, as you have already requested and paid for the SAR which you have received, which did not include your agreement, so for this £1 you will receive the agreement, good luck and don't worry you will get there.:D;)

  • right today i have received the rest of the sar request but it says "we have been unable to locate the signed agreements"

    now iv searched through my bank statements and found that the loan £6000 was paid into my account 20/01/2004, inital payment back to them was 01/03/2004 and final payment was29/01/2007

    now im still no further in knowing exactly what to write to the bank to get my agrement or even if i have 12 days as iv been told on here or 40 days as it suggests on the template letter! i even have my postal order written out but when it came to writeing the letter i quickley became stuck

    iv noticed im not the only one having/had a problem like this trying to get the agreement when they have no details so is there any chance someone could write a quick template for this stage

    im about ready to give in as all this is doing is giving me headaches!!!!!!!

    Hi there

    I note that you said you found your bank statements?
    I take it then that this will also disclose the account number next to the repayments, of when this paid into your account?

    I would personally ring the FOS and ask if they can help you with this matter, by giving them the details you have so far, if you ring them they can write to the business on your behalf.

    Yes your right, some have been in the same position as yourself, but also by reading on some of the posts, if there is no agreement to go by, just as long as there are some information on the finance.

    Sometimes these agreements suddenly turn up, if the FOS gets involved.

    The FOS did actually write a complaint on my behalf to one company, I'm sure they can do the same for you.
    I would explain to them your situation with this, and ask if they can help you through this.

    yeah the bank statements have came through today with the rest of the SAR reply, i have the account numbers for which the money came from and the loan went into and the fact they were for the rbs personal loan just no details for the loan itself

    FOS it is first thing tomorrow then
