Dodgy boiler installation when house built

Hi, i have boiler service plan with homeserve, everything fine. My boiler broke and i called them out, they replaced the fan which is covered and it is now working correctly again but they told me that my flue is too short, this was done when the house was built in 2003. Homeserve rang today to tell me this isnt covered as the boiler hasnt been installed properly but i have to get the flue replaced before i can carry on with my cover.
I was just wondering if i have any type of case with the builders Bryant, they built the house and obviously got all the contractors to do the work.

You should have the installer details. Contact them and tell them to replace the flue. If you have no luck contact Gas Safe.
These things will probably be quicker than going through the builders.0 -
As you have a new build property it should be covered by the NHBC buildmark insurance.
Building companies are only resposible to rectify defects for the first two years that the property was built then it reverts to the NHBC insurance.
The orginal installation company will refuse as there warrenty period will have expired as per the orginal contract that they worked under for the builder.
Contact the NHBC to see where you stand as the orginal installations would have been signed off under the bench mark scheme.0 -
Gas safety regulations have little or nothing to do with warranties. If the installer breached these, then the installer must put them right.0

The boiler may have been installed to standards back in 2003. Since it was 6 years ago standards may have changed.
When my boiler was due a service I was told by British Gas that I had to have pipe insulation as I never had one of these http://www.wickes.co.uk/Pipe-Insulation/invt/210012 for my condensing pipe outside the house. They never said that I was not covered due to this his notes suggested not to current standards.0 -
I think often that Homeserve find reasons not to cover boilers etc unless they've been fitted by British Gas - gives them a get-out. We have Home Serve and every year during the maintenance check the engineer will point out that something isn't to standard, followed by the phrase 'but it's perfectly safe'. This will undoubtedly mean they won't have to cover this part should it ever go wrong.....0
